MORTGAGES ON SHIPS.

AN EVIL AND A suggested reMDDY.

Facility for obtaining capital is of course very desirable in the interest of commercial development, but if the development is mora considerable than the trade warrants, snuh facility does harm rather than good. That of late yenes there has been too much British ton- mago either for the advantage of shipowners or pfossilors is now generally admitted, and it is also admitted that one oauso at any rate of this glut is the facility with which capital can ho obtained on lona for the purpose of building and running ships. This facility, as wo have recently shown, may be very detrimental to the interests of genuine investors in shipping, aud the question may therefore be put forward for discussion whether any or what changes are desirable in ragard to mortgages on British ships.

REGISTERED AND UNREGISTERED MORTGAGES. At the present time there are two class of mortgages, those which are registered in socordance with section 31 of the Marchant Shipping Act, 1894, and unregistered mortgages, which, though valid as between mortgager and mortgagee, rank bohind registered mortgages. evan in the case of a registored mortgag, made after notice of a

eqnitalie morgage. prvious That in som circles a considerable aut of juggling with registered and unregistored mortgages goes on is pretty clear, but it is not certain that the continuando of unregistered mortgagos has any considerable effect on the quantity of shipping. An unregistered mort- gago is a perilous seeority at the best.

Assuming, therefore, that the existing low in regard to unregistered mortgages should not be altered, the question arises as to the best means of permitting teassable powers of bor rowing, so as on the one had not to limit unduly the raising of capital on the security of ships, and on the other to secure not only the safety of investors' capital, but also to prevent speculation by impecunions managers in shipping propor speculation which tends to lower. freights and eamen's wages and to endanger the cupital of. investors who are not acquainted with shipping

business.

This is a question of considerable prootical difficulty, and, for the purpose of a definite conclusion, a careful investigation is required.

LIMITATION OF BORROWING POWERS.

At the present time the whole of a ship or the whole of one or more shares many ba muri- gaged. If the whole 64.64ths are mortgagod and are insufficient to pay off the ayuore, it is clear that the owners are left without a penny. It by no me as follows, however, that the mort- gogoes may not under such circumstances sell or dispose of the vessel to advantage.

CARDS ON A LINER.

A PASSENGER'S EXPERIENCES IN THE MEDITERRANEAN.

Disclosures as to card playing in a liner arriving in the Mediterranon from the East wore made ip ho King's Bench Division, London, Just month in an action brought by Mr. Arthur Floydoll. a Turf commission agent of Telford-avenue, Streatham, and the Hay market, against Mr. John Dongles M. Tinline, aged twenty-four years, son of the late Mr. Tinline, of Teignmouth, South Devon, and Mr. Edward Brown.

According to the evidence, Tinline, who last winter wont for a trip to Ceylon for the benefit of his health, nude tho ае quaintince of Brown and two other men who joined the ship on the return voyage ut Port Said, ond came as far as Naples, En route they played cards with Tining and won £6 in cash from him, and Tintine's defence to the action was that the signatures on the bills of exchange were not his or that he was induced by Brown and his friends at the time to -sign something” while he was in state of a in- toxication.

Mr. Plesdell told the Court he discounter MEXICO MARU, Japaneso str., 3,759, N. Kobs Kaiserlich Deutschen Konsulats in

the bills in good faith for Frown, whom he had known for many years. He said ho know noth- ing of the circumstances in which the bills were obtained, and in reply to counsel said he lad never heard a suggestion that Brown was a curd shorper.

Tinline in the witness-box admitted habits of intemporause, and said he was not quite sober when the card playing commenced. It waatuted that it had originally been the plaintiff's inten- tion to make Brown a defendant, but, his where- abouts being unknown, it had not been possiblo to serve him with a writ

At the conclusion of Mr. Tinline's evidence the jury stopped the ease, holding that the signatures to the bills were either forgories or had been obtained by fraud, and that the plaintiff was not the junocent holder of the bills for value.

Mr. Justice Darling entered judgment for Mr. Tinline, and said after the disclosures that had been made he would send all the documents to the Public Prosecutor, in consequence of the serious allegations against Brown and those who were with him when the card playing took place.
