11:

At the farther bearing of this case, Mr. H. H. Road, the prosecutor on behalf of the Stock Exchange, after giving evidence, asked the Court to allow him to make a statement. He said-Certain statements' have been made in this Court by Mr. Michael which in justice to my fellow members of the Stock Exchange as well as to myself I cannot allow to go1inchal- lenged, and I should feel obliged if the reporters would put down what I have to say. Mr. Michael has volunteered to make statements to the Court and these statezipata I must describe as malicious and mostly untrue:

Mr. Douglas-Statements made on oath. His Worship-Which are the statements? Mr. Read-He said that the Stock Exchange was like a grog-ebop.

By Order,

His Worship-At the time of grent exsite-FAUMATI ment, Mr. Reaî.

SHATIN

TAIPO M.

Mr. Read-Tho March settlement time. The March settlement was a record one and previous. experience told us that in order to get through the work some of us had to go TATPO without our tiffins and the Committee provided titles, and this was much appreciated by everyone. As to champagne and oaviare, many new members are not members of the Club, and when they are admitted it is the custom to put FAN LING up some refreshment at noon.

(Laughter.) This is also the case on the celebration of a birthday or on the occasion of a member's

LOWU departure. During the summer time we had su ide chest there and the only drinks available were very mild in the nature of ginger beer and soda water, and so on. As to dicing

His Worship-That came at a later time. Mr. Read-After the June settlement, and expecially after the Chinese failures, there was practically nothing to do in the share market and time hung very heavy on the hands of the share brokers. They did begin gambling for tin and

twenty.cent piscos, but one day they began to

gamble for higher stakes and the Committee peremptorily stopped it. Then he said that the brokers were afraid to meet their creditors. They were not afraid to meet their creditors, but the reverse was the oase. Then he said that everyone in the Exchange was insolvent. I emphatically deny this,

Mr. Douglas He did not say that; he said the Exchange,

Mr. Oppe Any way it was untrue.

Mr. Read-That is all that I have to say to your Worship. I apologise for taking up your time.

Mr. Douglas-There was no intention to cast any reflexion on yon, Mr. Read, I am surd.

I. E. P. Joues, barrister-at-law, was then sworn. Ha stated that oras iustructed by the Cathay Trust to bring nation in Mt. Michael's name against Mr, W. V. Carmichael. Subse- quent to the hearing of October 4 Mr. Michael addressed a letter to him. The letter was dated Shanghai, October 12, and it ran :—

Dear Mr. Jones, In again reading the Judge's questions to me, I find that my answer with regard to this question as to whether I ever owned any shares in any of the companies in which I bought altres for Mr. Carmichael is not strictly corriol. As a matter of fact I at one time (in March last) was allotted 400 Anglo-Javas; bat aa I sold these shares at once, even before the terip was ont, I was of course in no way ia- terested in the Company at the time. Mr. Car micheal bought shares through me: I also had 500 Semelings and 50 Kamuntinga allotted to mo (some of them long before I dealt with Mr. Carmiobuel) and considering that the shores of these companies were not dealt in by Mr. Carmichael I cannot seo that it has any bearing on the matter. Of course, my reply to the Judge should have been that I lad owned shares in the Anglo-Java Co, but that I did not own any at the time I bought shares for Mr. Carmichael.

I. R. MICHAEL Witness-At the next hearing I did not refer to that latter,

Mr. Donglas- Why did you not?-I did not think it necessary at the time.

Cross-examined by Mr. Oppe,

Mr. Michel did not to'l yon, did he, nt any. time, that he stood to make a very large job- bing profit the settlement-No, he did not.

Did he tall you that he stool to make on the settlement about Tis. 30,000 on jobbing, and if he had would you have considered that a rele. tant matter to bring before the attention of the Court?--I should probably have thought so.

Did you understand from Mr. Michael's answers to the Judge that he had not what is generally called jobbed shares himself? I can not say distinctly now what my impressions were at the time. I took the Judge's questions to be directed to show that Mr. Michael bad some interest which would make it rather difficult to carry out his duties as broker. His Worship-Do you want that answer to go down?

Mr. Oppo-Yes, I thick that answer pats it. very neatly.

His Worship-You ask Mr. Jones as an ex- perff

Mr. Oppe-He was in Court. (Te vitness). Did you think the facts stated in that letter would have in any way altered the impression the Judge hat received from Mr. Michael's an- swort-The statement contained in that letter did not seem to affect substantially the question, Have you any other latter of Mr. Michael on this point?-Nothing whatever.

Re-oxamined:

Mr. Donglas-It is clear from the letter that Mr. Michael did not understand the relevancy of the Judge's questions and his answers in the same way as you did P-The latter speaks for itself.

Mr. T. C. White, in which he states that after "SQUARE BOTTLE" he left the Court Michael stated that he (r. White) was indebted to him to the extent of Te. 61,070 The statement had been given publicity in all the papers in Shanghai, and he stated that he writes to me to give an un- qualified denial that he owes the accused anything. I think it is only fair for me to mention it,

In replying on behalf of the Crown, Mr. Oppe said that one peculiarity about the defence was the number of documents that had bean' lost or mislaid,

Various defences had been put forward on behalf of the accused. He, however, had dis. charged the onus upon him and he thought he had clearly established a prima facie caso. A jury could be asked if they believed Michael's. books or his explanation..

His Worship I do not think it necessary or proper for

me to

any opinion upon the evidence, seeing that I do 210t consider the defence has npsat the prima facic case on which I framed the charge. In the circumstances, Michael, you mast take your trial at the Supreme Court on a day that will be intimated to yon. You will, however, be admitted to bail.

Referring to the latter to Mr. Loftus Jones, which had been put in, in evidence, his Worship said that he thought it was peculiarly unfortun ate that it was not brought to the notice of the Judge in the upper Court. If it had been, he was convinced that the Judge would have had a good deal of the evidence before him that they had heard during this trial

KAISER'S BOYHOOD

AN INTERESTING LETTER ON THE BATTLES or 1870,

An interesting letter written by the Emperor William shortly after his 12th birthday to the commander of his regiment, thou at Versailles, bas just seen the light of print. It runs 29. follows:

My dear Colonel,-On my birthday I got. many nice thiù a, but the nicest of all the pre- Bonts is the shattered shot which you have pre- sented to me, This mighty shell is a terrible thing indeed, and what damage it must do when it is whole, and when it comes whistling through the air and then falls to the ground and barets! And it must make zu awful noise. I got a very great fright when I saw this shell, and I was filled with horror when I said to myself that there sugar-loaves are shot and thrown at our dear regiment and at our dear brave fellow. countrymen. But, thank God! this happens no longer. For three weeks a trace has been arranged, and it is to be hoped there will bo no more fighting. Then you will come back to us crowned with glory. How delighted I shall be to welcome you all again! When I heard of St. Privat aud Le Bourget, and still. of Le Bourget, I should, in spite of a great! fright, gladly have been grown up in order to be able to be there. In fact, I should bare liked to be with the regiment every- where It is a great comfort to me to know that no more of you are being shot dead. I thonk you my thousand times for your kindness in thinking of me and sending me this souvenir of this difficult time, through Count Finekenstein and the sergeant-major. Good health to yon, Colonel, may God protect and further guide you and the regiment! Please thank your offers for the attention they have shown me. My mamma sends her kindest regards Yours vory troly (signed), Wilhelm, Prince of Prussia, Second Lieut. enant in let Foot Guards,
