Mr. Matthews report was very inaccurate. Mr. Matthews ought to have had witness second book to make his report. This book was handed in to the Supreme Court, and after the case was over It was given to Mr. Jones. Witness called upon him one day he did not remember wlück-and asked for the return of his booke. Mr. Jones him back one book and the Carmichael KATE contracts, but retained the other book in con nection with some other defaulters Witnega took the book he was given home, and when he was suspended on December 9 he want to Mr. McKean with the books and the contrasta The lost book was among those witness hand- ed to Mr. McKean. Some days afterwards Mr. McKean asked for the first books Witness then wont to Mr. Jones and asked for this book, which was given to him on his signing a receipt for it. Witness took it straight to Mr. McKean, Mr. McKeon then discovered that he could not find the second book-the one that witness had previously handed to him. Witness had searched again and again for this book, but had not found it He could not remember whether Mr. McKean had ever given this book back to him. If wit ness had overbought or oversold shares for the Juna settlement he was unable trace them, because he had handed all the shares to the Cathay Trust Witness believed he had over bought 25 Kroewosks. He had not over bought or over-sold any Anglo-Jaras ur Java Co soll-place between the end of November and dated. After the June settlement witness was December 22. Accused's books were handed il and went away to Japan.
over to Messrs. Lowe, Bingham & Matthews Cross-examined by Mr. Oppo Witness on or about December 28, sent out settlement accents, of which he kept no copias, to his clients. He had bad considerable experience in stock-broking, but be was not a stock-broker in London. Witness kept a book- keeper for there months from April onward, last year. Sometimes witness filled in counterfoils to his contracte, but when he ran short he used loose contracts. During the boom he had not time to enter up counterfoils to the contracts. He bed filled up the counter foils of one book of 100 contracts. The contracts were made in duplicate; one copy being given to the buyer or to the seller, as the case might be, one copy being ing retained by witness after confirmation by the buyer or seller. Witness recorda wore his
book and his due copies of the contracta,

of his account with Mr.
Mr. Oppe called for all the contract notes of witness transactions with Mr. Somekh.
Witness went on to say in further cross-ex- amination that Somekh was an outside broker. He produced a copy of his account for receipt and delivery delivered by witness to Mr. Bomokh for the June Eettlement Mr. Bomekh had not paid witness. Witness might have began the second (missing) hook in February Both books were being run at the same time. There must have been at least 15 names in the. socond book Witness had a clerk who was new to the business and both he and witness made a meas of things. It was not a fact that the second book was only started when the first was Inished. He could not help his derk keeping two accounts on the same page. It was not a fact that all the accounts in the second book had merely been carried forward from the first. Witness could not explain why his clerk had pat Somekh'a zame in the second book. At the June Bettlement witness had to receive Tis 250 from Mr. Kadoorie. The correction in Kadoorie's account in witness hook was male on the day of the settlement, and was in witnes own handwriting. Why was he bound to make the correction two centuries ago P If witness" credit was good enough for Tis. 475,000 Ka doorie would trust him for Tia. 200 Witness understood from Kadoorie that he was buying the shares at The 26. It was an exciting day. In the Exchange they wore drinking cham- pagne and eating caviare. Carmichael had given witness carte blanche to buy those shares, and as Kadoorie sont him a contract note at T 27, witness sold them to Carmichael at Tle., There was great excitement in the Exchange

This boole was continuation book and witness asked to see the pravions book before going into the matter. Witness, as far as he could, checked the con tinuation books with the other books, and then handed it back to Mr Michael. He asked the latter for his previous book and subsequently it was obtained; he had handed the continuation book back to Mr. Michael; he could not find it in his office.
