SHIPPERS AND MERCHANTS.
In the City of Loudon Court, last month. point of some importates to shipowners nud merchants was submitted to his hannar Judga Lumloy Smith, K.C. The time-chartered owners of a steamship sued a timber merchant for balance of "toight. In those streuumstances it had been the practies of freighters for a considerable time to adopt the form of dofonce used in the oaso. Subjoot to the counter-claim the defendant admitted the elnim, and counter-claimed for shortage. Defendant contouded that the money should be kept in conyt untill the trial, whereas the plaintiffs wanted to take it on. Plaintiffs wore an English fives, but the principle was the same. There was no hardship in keeping the money in court,
The Registrar (Mr. J. Anstey Wild) had decided that the money paid into court must l paid out at once, but the point was important. and it had bon reserved for the jungo.
The plaintiffs solicitor submitted that the Registrar was right. Dofondant wanted some. thing read into the rules which was not there. The Court had no jurisdiction to keep the money in emirt. There had been an absolute tender, and the plaintifs had accepted it.
Judge Lumley Smith said the plaintiffs' best polat was that it was no good for the defendant to pay the money in if the plaintiffs could not get it. As the point was important he would take time to consider his judgment.
