Mr. McKean introduced this evidence to satisfy the Court as't. Mr. Pitts' whereabouts, and asked for a warrant to be issued against Pitts, Witasss stated that Mr. Pitts lett Shanghai about the middle of August. The dooz. ments witness produced came into witness' possession because when Pitts left he tell the typist to put the documents of each estate into a parcel to keep as a record. docaments witness now produced had been placed in a bundle. None of the documente pre duced in Court were obtained from Pitts after he had left Shanghai. Witness identified one of the documents he had produced, He had found it in the bundle. It was endorsed in ink by Pitts. The body of the document was not in Pitts handwriting. Witness also floatified a receipt from the Eastern Extension

$98.05 for telegram No 1947, to Meden, dated May 11, 1910. The receipt was endorsed in Pitts handwriting.

Telegraph Co., made out to Lind and Pitts, for

Gerrit Jan Nijhuis, sword, id-I put a Dutch subject and a Doctor of Law, and the representative of a Dutch Syndicate that owned three estates named Sengei Sink, Sungei Olak, snd. Looboe Ampoï. I knew a man called William Pitis. I fist met his at Raffles Hotel, Sin: apore, in the last days of November, 1909. At that time I met him in connection with the Tanjong Pinnang estate. On January 25, 1910, I wrote a letter to a Mr. Macleanad, the agent of Lind and Titts at Singapore. On February 10I wrote to Lind and Fitts with reference to the, three estates. This is a trus copy of that lolter (produced and put in). After the dispatch of that letter I came to hanghai, arriving here on March 5. Three. gentlemen met me, Dr. Ransome, Mr. Lind and Mr. Pitts. I stayed at the Astor House, Mr. Pitts was also living there: The first evening I spent in Shanghai was in the company of Mr. Pitta. The following day Mr. Pilta asked me to go to Mr. Craig's residence in Babbling Wol! Road. I went there and met Mr. Craig. We discussed the question of the three states, be- canze Mr. Craig wanted particulars with a view to purobusing them. I referred him to the documents and my letter to Lind and Pitts. I saw Mr. Craig again next day at his office. It was on that date (Monday, the 7th! that Mr. Craig agood to buy the estates. On March: 16 an agreement for sale was made out and signed by me and Mr. Craig, This is the original agreement (produced). Between March 7 and 16, 1 saw Pitts every day. On March 7, when I called at Mr. Craig's office, Mr. Pitte was present. At that interview Pitts proposed that I should make only one agreement with Craig & Co, and pay him a commission. At that time I was not willing to give Pitts five percent, as I thought I had sold the estate to Liud and Pitta, Eventually I agreed to pay him T. 10,000. Mr. Craig proposed that the parchase price should be Singapore $360,000, and that he should pay Tls, 10,000 to Mr. Pitts,
