I
PARTITION OF PROPRITY. Action was brought by Hormann Elmer and Ms Man Sing against Ng Chi Wai and others aiming for the partition of eartain property op Inland Lot No. 102 in respect of claims which they hold as mortuagore. The plaintif Ehmor is a merchant siding at Schwstomok, Ham- burg, Germany, and the other plaintiff is a Mr. M Blade, trader in Jervois Street, Instructed by Mr. Shouton, from the offre of Messrs. Deacon, Leokor & Dancon, appeared for the plaintifs, and Mr. G. C. Alabaster, instructed by Mr. Roader Harris, of Messrs Wilkinson & Grist, appeared for the defend ante.
Mr. Slade explained that one of the defond- outs was ad infant and his Lordship had to be atisled that the proposal which the plaintiff, put forward was for his hanelt.
Of sourso su infant could mako no admissions, but the other defendants admitted the accuracy of the material allegations in the statement of claim. The undivided property, which was held is very complicated shares, had been mortgaged by the sdalt defendants to secure a compradore to the frm of which Elmer was the present repre- sentative. The money was due on that mort- gago, and Ehmer, noting under the powers con- tained in that mortgage, sold the property to Ma Moa Sing. Of course neither the mortgage nor the agreement for sale touched the infant's undivided aharo in any way. Now the plaintiffs came to the Court and asked for a partition of the property as botwoon the four adult lofon dants, whose property had passed to Ma. Man Sing and the infant. In lieu of the partition, however, an offer had been made to the infant to sell his share to Ma Man Sing. The offer was boneficial one, and if his Lordship would samotion the mile in lion of the partition the infant would greatly benefit.
His Lordship-How can I do that? Mr. Slado-There is direct authority. His Lordship-How can I do it in this esse? Mr. Siado-This is the proper form of action. It is a partition action. A partition is very often effected by a payment in cash, and the Court in lieu of an order for partition of the property has jurisdiction to order an entire payment in cash to any party was is willing to socopt it,

Mr. Slade They are out of it any way. Their interest in the property was mortgaged and their undivided interest has been sold to Ma Man Sing. The infant did not mortgage his share.
