A QUESTION OF "L PENDENG."
The question of a perleis raised in the nction brought by Kwok Ah You against Kwok But Chi ood Mr. Crowther Smith in a property dispute, having been argued on several occasions, was decided by the Chief Justice. In the course of a lengthy julgruent he reviewed the doctrine of lis pendens, and stated the conclusions at which he had arrived after a study of the cases to be as follows: (1) lis penders relatas only to real. property; (2) that the registration In the Land Office gives noticelo theworld that there is sclaim against the property, in litigation and that persons intouding to deal with that properly are to be on their guard; (3) that if judgment is giren in the plaintiff's favour the judgment} relates back to the registration of the lis pendens and that judgment will then take priority over any male or mortgage subsequently registered. All this, he hold, was right and proper and in the best interests of all partion. A registered judginent oporated as a chargson realty, and the mortgageo in advancing money to pay off the judgment was doing procitaly what the law itself did by making the judgment a charge on the property, and therefore he was entitled to the benefit of the execution.
