His Lordship stated that after a full con-26. alderation of the authorities cited and others, he was of opinion that plaintiffs were entitled to the a sts of the action, and the defendants to the costs of the counter-claim, excepting the costs of these issues on which the plaintiffs had succeeded He also ordered, as was agreed to in argument, that the costs payable by the defendants to the plaintiffs be set off against the sum which lud been found to be due from the former to the latter. If there was power to order the payment of interest, which at least appeared doubtful, he SAW DO sufficient grounds for ordering such payment in this case.
Mr. Potter asked that the money paid into Court should be paid out to the plaintiffs, but Mr. Blade opposed the application, and argument was deferred.
