The minorandum attached to the Bill shows that under the existing Pension Rules there is a rule (No. 21) declaring that the Governor-in- Council is empowered to retire any Pablic Officer at the age of sixty. This role is without any statutory authority and is therefore ulira vires. It is therefore desirable that sub-statut ory authority should be given to the Governor in-Council.
