TEM FABLE MISSION: LEBEL CANK. The decision of their Honours Mr. W. Reer Darles (Acting Chief Festive) and Mr. H. H. J.Gomperts (Paisne Judge) on the points of law raised in the libel action brought by the Baule Mission against the Chinese newspaper Shoung Po was delivered yesterday.

Mr. M. W. Blade, Instructed by Mr. F. B Deacon (of Messrs. Dunoon, Looker & Descon) represented the plaintiffs, and the defendants were represented by Sir Henry Berkeley, KC, instracted by Mr. Otto Kong Sing

The Chief Justice, in delivering the judgmont of the Fall Court, stated that this was an action for libel brought against the proprietors and editor of the Shenny Po newspaper by the President in Hongkong of the Basle Evangelical Misionary Society, which it constituted a Corporation solo by Ordinance No. 2 of 1896.

The article complained of was published in the W. Carson, H. Q. Brawn, F. Button and have been awarded byǝs-Queen's College, Harnainy Bla

paper on December 24th, 1908, and was alleged to have been printed and published of the plai tiff in relation to the plaintiff's business or

profession, and the carrying on oronduct tharost, The article complained of professed to be a arrative of an occurrence of the Society's hospital at Ho Yuen an December 17th. The sots related would possibly be sufficient, If they had been committed within the jurisdiction, to ground a charge of murder against the doctor, and a chargo against the missionary sa an so- cessory to the crime. In any case, the article smonated at the very least to a grave charge of professional misconduct against the doctor misconduct suggested to have been committed with the knowledge and concurrence of the missionary. If the article was believed by those who read it, it must naturally have injuriously affected the reputation both of the doctor and the missionary No evidence having been called for the defendants, the jury returned a verdict for the plaintiffs with $2,000 damages The Chief Justice had grave doubts whether in the present eation he should bara the case to the jury at all. It was a libel action pure and simple, and not an action on the case for a false statement causing damage to the plaintiffs. Mr. Slade argued that as the words complained of purported to be a narrative of the sets of the plaintiffs' narrauta, done in the re. gular course of the plaintiff business, they were words which must injurionily sffect the plain- tiffs, and this action would therefore lie. It seamed to their Lordships that when, as here, a single cocurrence was related. suggestion of other malpractions or any

reflection on the plaintiff corporation gan-❘ erally, that it smounted to no more than olmarge, whether of criminal or merely, of unprofessional conduct against the persons referred to in the publication, and was general to them, It was no more than an imputation of gross misconduct against two of the plaintiffs" servants. Their Lordships could not so that there was anything which could be construed Into a statement defamatory to the Corporation Itself, or of its business. There was no evidence whatever that the wards complained of re- ferred to the plaintiffs.
