All tenders so made will (except at the express wish of the tenderors to the contrary) be received and treated by the Government as strictly non- aldontial:
On receiving any such tender, Government reserves to itself the right of deciding whether it shall be considered or not.
If Government decides not to consider the tender, it will be returned to the tenderer under Healed cover.
All tenders accepted for consideration by Government will be, in the first instance, retained by Government for further considera tion with the tenders handed in on 1st October, 1909, which will the opened at noon on that dafe, after which the successful tenderer will be selected.
3. The Farms, above referred to, are:- BRITISH NORTH BORNEO-OPIUM. SPIRIT, GAMBLING and PAWNBROKING, AN follows:
(a) in one concession for the whole State. bin one concession for any of the following Districts of the State, the limits namsi including the interior territory watered by the rivers within the limits given respectively:
(i) SANDAKAN DISTRIC-the Territory bounded on the one side by the true right watershed of the Kinabatangan River and on the other by the true loft watershed of the Paiton river.
(1) KUDAT DISTRICT the Territory bounded on the one side by the true left watershed of the Paitan River and on the other by the true right watershed of the Pindama Karer.
(ii) WEST COAST DISTRICT-the Territory bounded on the one side by the true right watershed of the Pindasan River and on the other by the Northern Boundary of Province Clarke.
(i) EAST COAST DISTRICT-the Temitory bounded on the one side by the true right watershed of the Kinabatangan River and on he other by the Dutch Boundary on the Sonth -nt Broerskoek point.

CONDITIONS OF TENDERING.
1. No tender will be received unless the ten- derer proluces a receipt from the Treasurer
for-
(i.) A deposit of $30,000, or of Title Deeds, otlier approved securities to a like amount, and
(i.) Aungreement to be executed by him ou form provided by the Treasurer, to the effect that, if he should decline to accept a grant of the Farm on the forms of the tender sent in by him or fit to give the prescribed security for sch graut, such deposit or securities shall be forfeited to the Crown. Such deposit must be completed not later than Noor on the 29th day of september, 1909. All deposlis will be returned to unsuccessfal tenderers.

3. The Government does not bind itself to accept the highest or muy tender,
