APPEAL FROM A JUDGMENT OF THE CHIEF JUSTICE.
This was the fifth day of the bearing of the appeal in which the Hip On Exchange and Ican Co., Ld, and the Hongkong and Marila Yuen Shing Exchange and Trading Co., Ed., ware appellante, Li Po Yung being respondent.

It is satisfactory, however, to by Mr. F. Pagot Hett (of Messrs. Brutton and learn that notwithstanding the many dificulties Hett) for the respondent which had to be surmounted, both as regards

Incidentally, it may be insationed that the Waite family claim an unbroken record of four generations who have worked for the public in the construction of ways and menna of transport. In February, 1928, tlie Governor sznounced that the expenditure on the tunnel exceeded the estimate for the previona ye by $198,977. This was abonnted for by more costly labour than was anticipated, and by the large quantity of explosives it was found
Brst thousand yards from each face of the tunnel necessary to use by reason of the fact that in the semi-docomposad granite was encountered for which explosives were practically unless, but which was too hard to be removed by pick und shorel. After cutting their way through this, the excavators were confronted with axedingly hard rock.
