Defendant represented himself as the managing partner of the San Yee, and he was the only man plain- tifs had desit with. At his request they gave him a pass book which Mr. Grist had had notice to produce, bat defendant denied ever having" hed one. He made various payments on account, and promised to pay the balance. When pressed by plaintiffs he said he would pay the money when he sold his property at Pingohow."
After hearing evidence his Lordship found the plaintif was entitled to his money, but be had told a string of lies to get it. If he had told the truth it would have shortened matters. copsiderably. Each side would pay its own costs.
