There was evidence on behalf of the appellant that food and lodging on shore would cast him 16., a week. Evidence for the respon dents consisted of a deposition by the ship's stoward that he bought the stores for the ship, and calçalated that the cost of them to the owners worked out. at 2 3d. per head for each ordinary seaman per diem, sad the ledging at 4d. per diem. Mr. A. Neilson appeared for the respondents. The Court, on Tuesday, without valling upon- counsel for the respondents, dismissed the appeal.

that the Workman's Compensation Act did not attempt to defiue with mathematical accuracy the amount of compensation payable in oh case; the keynote of the Act on this question was to bo found in Clause (z) (x) of the first schedule to the Act of 1908, which said, "Average weekly earnings shall be computed in soch maanar as is best calculated to give the rate per week at which the workman was being remunerated," and then certain special directions and provisions were given for particular in stances, none of which applied to the present case.
