T. MATSUKI; Manager, Hongkong, No. 2 Pedder Street:

The whole-question of Aciatic immigration as it affects the people of this part-of-the Pacific Cast is yet in its infancy. It will before long. bas serious problem, and one that before many years have alapsed will hare a serious effect upon the relationship of the Colonies which ar washed by the Pacific to the Motherland. if the Anglo Japanese Alliance is renewed. There is no doubt that, despite the in which the political opportania's have seized upon the matter, the sentiment nf the West is strongly opposed to the Japanese, and that the repentur of the gates: which the province seeks to close by Federal or Imperial pressure will but intensify that attitude.

A Commission to investigate the whole ques tion would render a most valuable service, not only to the Empire, but also to the English- speaking world.

LADY LAW CLERKS.

NOVEL SCENE IN THE COURTS.

For the first time in the history of the Law. Courts two ladies made their appearance BS solicitors' clorks. This strange innovation was witnessed in the Chanoary Court, presided over by Mr. Justice Neville, who was called upon to decide a claim to £50,000.

At the table provided for those instructing counsel the young ladies were usated. In front of them were largs piles of documents, with which they busted themselves, When any partianlar paper was referred to in the course of the proosediuge it was unearthed by one o the ladies and passed on to either judge o counsel with an alacrity that astonished those who were interested spectatora.

Occasionally they made hotes of the evidence, pared hints to excel, and displayed such Instness aptitude for the work before them as to create general surprise and wonderment. Both were attired in nest costumes, and wore hats relisret with a little colour.

In his judgment Chief Justica Hunter said: It is, I understand, admitted that appli- canta are subjects of the Emperor of Japan, and they come before the Court to decide on the validity of their detention. So far as I can, it is not pee sary to consider how far this so- called Natal, Act in repugnant to the terms of the Canadian Immigration Act. My present opinion is that it te noi repugnant to that Act No section has been pointed out where any positiva standard is laid down by the Act as to who shall be allowed in or wha kept onto are only specified class. Innamach 11 the British North Americs Act permits the past went of Iws relating to immigration by local Legislatures so long as they are not repugnant te any Act of the Parlament of Cenide, I should say that the provisions of this het, known aa the Natal Act, are not repugnat to the provisions of the British orth America Act. At any rale, I have chian to the conclusion that it is not necessary to coa- sider whether it is ultra vires of the local Ingis. lature. I have only to consider how far the provisions of this Act interfere with or nullify

Their employes appeared to leave the arrange. the Act known as the Japanese Treaty dot,

ments for condzoting the case in the control of which was passed in 1907 by the Parliament of the two la lies, and in conversation be remarked Cenade. Now that Act recites the Treaty bit they had every phase of it at their finger- tween the In parial and the Japanese Govern- tips. ments, and proceeds to enact that the provisions Ona, he said, was his managing olerk, aud of the Trenty are sanctioned... The question both were entirely trustworthy. He considered is. Do the provisions of the British Columbia they were better than men, as they did not det contradict the provisions of the Act drink, smoke, or bet, and would concentrate known as the Japanese Treaty Act? The their minds more on the business before them, British Columbia Aot lays down certain condi tions with which persons seeking te onter the provings must comply. Amongst them is one that they must read or write in any langusg- of Europe, the obligation being set out in a certain schedule. Now when we look at the Japanese Treaty Act we find in the broadest way that the subjects of each of the contracting parties has full right to enter, travel, and resida in the country of the other and to have fall pro tection of their property. It is to my mind absolutely impossible to argue that, the analian Government baring this power, the provisions of the Natal Act are not in contravention of the Treaty Act. It is very clear to ms that the Natal Act is inoperative to far as it concerns the subjects of Japan. It is not necessary for me to decide that the Natal Act as a whole is inoperative, but it is inoperative so far as it concerns the subjects of the Emperor of Japan,"

An appeal was at ones taken from the decision. and was heard by a Court of Appeal, consisting of Justices Irring, Morrison, and Clement,

It is probable that British Columbia will now earry the case to the Privy Council, if the right of appeal is giten. Mr. Cassidy argued that the provinces had righta given thom under the Betish North America Act to deal with immigration, and that the provisée was within its rights in passing the Immigration Act in question. He farther claimed that the Dominion Government, haring no right to make a Treaty with Japan had no right to sanction the Treaty, Jadge.
