EXTRADITION OF CHINESE, SI-In view of the many misleading and incorrect statements, reflecting not only on the action of the Colonial Government and its officers, but also on the conduct of the Chinese Government and Chinese uffoisis, which have Appeared in the local press on the subject of the extradition of Chinese, I am directed to request you to be good enough to publish this latter for the information of your reader,

The Viceroy of the Provines in which the alleged crime has been committed forwards a requisition to the British Courul at his Pro- vincial City for transmission to the Governor of Hongkong requesting the Governor to hand over the Chinese subject charged with com; mitting the offence to a Chinese officer specially detailed for the duty; this requisition contains

• •pecific undertaking by the Viceroy that the accused, if handed over, will be tried in the pressues of a British Consular Offear for the offenes in respect of which bis-extradition ia demanded and for no other offence, and this undertaking is invariably carried out,

Upon receipt of this requisition the Governor orders one of the Magistrates to have the accused brought before him and to enquire into the charge. The Magisterial saquiry i conducted in the saine mapper Be in the case of a person nonused of the ormai NIOU a crime in Hongkong, and if the Magistrate Ends that the evidence is sach that in the cass of a local offence he would commit the accused for trial at the Criminal Sessions, be cotimits him to gzol ̈to await the " further order of the Governor. During his trial the accused has all the rights and privileges of a British subject charged with a crime,

The depositions are then forwarded by the Magistrate to the Governor together with a report on the case; an interval of fifteen days elapses daring-which the sensed may apply to the Supreme Court for a Writ of il abess Corpus, then, if no such application is made, the Governor may order the accused to be handed

over to the proper Chinese oficial, who conducts him into Chinn for trial before the

proper judis, of the Provincial City whence the requisition emanated. Such trials held in the presence of a British Consular Officer, and unless the accused is then convicted of the offence" in | respect of which he has been handled over, he is restored to British Territory and set at liberly.
