Grey-The assessor is there to see thest the trial is properly condneted, and it is in the inter st of the British community that he should be there; but the prisoners are tried according to Chinese law, and the sentences are given by a Chineso magistrato appointed by the Tootai. I am not prepared to admit the accuracy of the description of the sentences in the question, but we cannot alter Chinese fun or infrago Chinese jurisdiction.

M. Marks-May I ask the right hon. gentleman whether the sentences inflicted in thesh courts require to ko approved and sanction- ed by the British Consul?

Sit E. Grey-No, sir, I do not understand the. They are Chinese seniouees, and the courts are Chinese courts, and we cannot alter them without infringing Chinese jurisdiction.

Sir B. Groy-The duty of the assessor is to see that the trial is properly conducted. He cannot control the Court or the sentences. As a matter of fact, there was the other day at Shanghai a case in which the assessor did inter- fers toyond what had osen the usual practice, and the Chinese magistrate thereupon closed the Court, and there were riate in which several persons were killed and injured. It would be most avui able to try to infringe on what has been the established Chinese usage.
