THE SHANGHAI MUNICIPALITY AND MIXED COURTS.

An important memorsadun, drawn up Mr. R. 8. Gundry. C B., on the store subject was sent in to the Foreign Office on Feb. 2 by the China Association. In this document, be states:

the

It is regrettable that the question shall have orison, because the position at Shanglisi is incontestably anomalous, resting rather an aggregate of precndents than

ou any definite textual basis. It has grown up with the growth of the Settlement, and has worked well in the interests both of Chiness and foreigners, so long as it was worked with good will by Ronsible masa who wished to zaintain gand relations. Hurd and fast maxims that may be perfectly of international Jaw upplicable in Europe are unsuited to a situation which is probably unique. That the Shanglisi Municipal Police is in the sabit (with approval of the Consular body) of exeroiding ever Chimes subjects on what is still (though hased to foreigners) Chinese mil, a degree of control beyond what has been formally ceded by the Emperor is ยก denied. But then it is an anomaly that some 400,000 Chinese should profar to live within the precincts of this Foreign Settlement, in- stand of in the adjacent native city and suburbs, That they de su is duo, presumably, to a latent appreciation of good order, good goverm

other good roads, immunity from equeezing and forms of arbitrary annoyanes. It is under these peculiar conditions that the system of Municipal Government suomalous, admittediz in many respects, but excellent (alsoulsmittedly) in practice has grown up. Where there is so mach of foreign life and property at stake it is essential that good order should be main- taino, eran if this involves au exercise of powers that do not properly belong to us. It is out of a tacit reguition of the facts by both Chinese and foreigners that the conditions bitherto existing have be evolved, The Superintendent of the Foreign Police co-operated with the Superintendent of the Native Police; the Foreign Assessor, ax I have | often heard Mr. (afterwards Sir. Chalover) Alabaster say, when he was acting in that capacity, sheltered himself behind the native magistrate and the magistrate sheltered hingalf behind the assessor. A system which has worked well for more than 40 years' stands self- appraise. It will be infinitely regrettably if the Ministers at Peking allow it to be under- mined out of deference to tenable, possibly, but inapplicable theories.

It that the conditions are anoosions. Bat the obvious solution is for China to carry out her promises of reform, not for us to lower our standerd to kor lerol.

A more favourable attitude is being taken. torrards the dazzling scheme for a tuunel under Botring Straits and an all-rail route from United States to Europe. Baron Loleg de Lobel, representing the American Trans- Alaska Siberian Company, is again pressing the project vigorously and has made considerable. progress towards securing concessions from Russia. accomplishing this Bud but for developing the resources of Siberia,

The Company, which believes the Siberian sida is

is as rich in gold as tho Alaskan side, offers to construct the tunnel and build a road 3,000 miles in length from East Cape to Kuusk, in the Clovernment of Yeniseisk, where it will join the Siberian railroad, on condition that after- nate sections eight miles on either side of the line and that the mining concessions covered be granted the company,

Reparto concerning the angineering diffeal- ties and the financial responsibility of the promoters, etc., have been submitted and were goverally favourably received by the Ministers The Emperor Nicholas has created a mixed com- mission, before which Baron de Lobel will make a final

argument on March 15th and ask for 18 malls in which to complete arrangements and tou years to finish the road. Should Russia, for stratagie rauaous, ask that the road, instead of following the Lens River, go directly east- ward from Kausk to the point whenso connee- tion would be made with Klarbarovsk, involving detour of 1,200 miles, the company is willing accept this on condition that American materials be admitted free. Generally speaking, the activity of Americans in seeking to secure concessions bus aroused the ire of the Radicals who so therein the desire of the bureauoracy to sell Russia to foreigners on the eve of the convocation of the Dumu.

to

Baron Loie de Lobel, on March 17, placed

before the National Defence Committee the project of the American Trans-Alisatie- Siberian Company for tunnelling under Behring Strait, and building a railroad from East Capo o Kansk, to connect with the Siberian railroad. Barou de Lobel offers to make any changes necessary to moot strategie considerations,

to

M. Teulchinski, Chief Engineer of the Irkutsk railroad, was the principal technical opponent of the scheme, contending that the construction of the tunnel was impracticable and impossible on account of the action of the tides. M. Taulchinski asserted that the shifting tundra of Siberia would necessitate the building of

extensive dykes and long bridges for proten tion from spring fraslets. Besides, M. Ton!. chinski claims that the climato of the region covered by the plan makes it unfit for Russian colonisation and that the only result could be the evoutual plucing in the hands of onterpris gricans of the whole unpopulated territory from the Pacific to Kamchatka.
