Punchard, Lowther and Company. pointed out to his Worship, that he would apply for a re-hearing if the defendant was convicted, and would probably apply for re-heminge in some of the other gases. He submitted that his Worship had not sufkoient evidence to prove that all the defendents were gambling, or were running away from portions of the yard where the the gambling was being carried on.
Under anch circumstances he contended that all the defendants, against whom there was no direct evidence, should be granted a re-l aring.
