not join misdezacour and felony in the same indictment. In this Colony they were allowed to join them.
The Attorney-General in opening the case for the Crown suid lo thonght the jury when they hul heard the ovidence would have no hesitation in funding the prisoners guilty on all three counts. The facts of the case were as follows:- Fong Tee Fat was a fisherman at Tai O and he and his boat moored there. on the Inering of the 6th July. There was a
of Holb marauding shermen gang Hometimes fishing aud at times marading --who had been in the habit in years past of levying blackmail ou the peaceful fisherman at Tai ; but this year Fung Tea Fat, tho com- p'ainant, advised his fellow-fishermen to resist the binekinilere' demand. Three ringleaders of the gang came to this man's boat on the morning of the 6th and demanded from him $100, which he refused, They threatened him and then went away, saying they would come back. About loven o'cheek, a mob of about 80-returiud among them the four prisoners, They were armer with revolvers and swords.

The gang could not get their junks sufficiently near, so they Isft them and walked along the bank of the creek until they care opposite the complainant's bout. They thum called out to him. mude a great noju, threatened him und demand. ed the money previously asked for. In the meantion the complainant, fearing troublo us a result of his refusal to pay the bluckmail, ad nrmed himself and his crew, and when threatened with violence by this armed gang he throatoned to return the violence upon them unless they went away. The show of resistance male tie gang go away. While they were still threatening him lio got a report made to the police, and Sergeant Floyd turned out all the Indians in the station down to the village while he himself took to the water in a police bout. When they approached the place he saw a boat making off with two of the prisoners in it. They pursued and captured them. About 40 of tho pang ran off over the hills. Au Indian con- stable managed to capturaons of these who was running away by threatening to shoot him, and another was found on the hillside hiding behind
a rock.
The jury after henring the evidence, found the prisoners guilty on all counts.
His Lordship in possing sentenco said he wondered at the audacity of these men coming into British tomitory and acting as they had done. In their own country they would have their heads off very quickly for a similar crime. The English law was more morciful, but it was murs murs, and they must not attempt evor to do this sort of thing again. Each of there would be sentenced to two years' imprisonment with hard labour, and in order that they might realize in their persons that the English low would not permit his sort of thing, each of them would have 24 stroke of the birch within the first month of their imprisonment.
