to have fraudulently concealed from plaintiffs the true value of the property and frandulently induced them to execute a release; also that in that release the value of the property in Hongkong was falssly and The frandulently stated to be so and es. reforeo's certificate showed that defendant's statement of fuels was perfectly correct, that his division of the properly was more than honest that was to say, be made for the plain- tiffs all that they lived on for 17 years, and the cortificate showed also that the division was atinde and the release signed when the youngest Bon resched the age of 17 years, according to the will. An acknowllgwont from the sons was got and though defendant never stood upon that he said he was bound to tako it when the yourgast-san reached the age of 17, secording to the terras of the will. Defendat store the estate at $6,400 although it was only 84409. Mr. Bruce Shepherd found it was only worth $5,000, nud was bordened with debts to the amount of Stque, so that it was absolutely insolvent,
· Compounel interest was asked for on the basis of fraud. In counsel's statement at the former bearing of the case the point of frand was stegly enforced.
ifis Lordship said he thought according his recollection that the plaintiffs said they could not do anything while this release continued and they asked that it be set aside. After emniy plaintiffs' solicitor, Mr. Thomson, when he had board the evidence withdrew the allegation of dishonesty, admitting that it was groundless; and Mr. Bruce Shepherd referred to that in his certificate, also submitting that plaintiffs' caso of frand was wholly groundless. Defendants asked for judgment and ecsta. At the same time there was a truimical faw in the defendants'
vase.
The executer should have asked the Court to fix the ramuneration which he should have for carrying on the business instead of fixing it Litself; and therefore the plaintiffs had got something to go upon.
Mr. Sharp said he would ask his Lordship to grant a rewaneration, Mr. Bruce Shepherd having found that the defendant was entitled to remuneration..
His Lordship-That would make a variation
of the cortificale.
Mr. Sharp-They have asked for a variation of the certificate.
His Lordship-I think the safest way would be to give judgment and cesis.
Pow Ting, one of the plaintiffs, was then put into the box. Ho stated that he had authored his brother to bring this action.
His Lordship, addressing Fow Ting, said that un 22nd January, 1876, his father died and left the defenduat Pau Kwok Übin as execntor, Probate of the will was granted on 11th February, 1876, to the defendant. At that time Pow Ting and his two brothers were small boys and that part of their father's basiness which related to getting ontracts from the gaol was worth $400, as had been expressly stated by Mr. Bruce Shepherd. If the executor, as he might very well have done had he not had the suns' interest at hoart, had. sold that business it would have fotched $400. Bat that basineSA was carried on by the executor in the interests of the family, and there was a very personal olement there, for the erecator had to secure the contract from year to year as the tender s were put up. He carried it on for a great many years and the plaintiff Pow Ting and his brothers gul a sum of some $7,000. There was only ose technical flaw in the executor's conduct that his Lordship conlt discover. Instead of taking three-tenths, which was a'vory Isasun- able sam indeed, for his trouble aml risk in the matter, if he had asked the Court to fix for him the remuneration, and tho Court had allowed Lim, which he thought would have been a reason. ablo sum, about 850 a month for carrying on the business, that would have been 8800 a year, an in 17 years that figuro would have come to $10,900. With regard to all the rest of the property, n his opinion, acting upon the unelallenged repert of thesp, cial referee, Mr. BruceShepherd, who had gone very carefully into this matter, ho found the exacntor had done his full duty of the three boys. He had done a great deal more indeed that most executors would bare done. The will directed the pipperty to go to the three boys when they had, arrived at the age of 18 He supposed the father thought they would have sufficient wisdom by that time to deal with the property. As a matter of fact the executor did give them the property at that dato, 1511 April, 1893, and took from the three boys a full release which they all signed. If they had acted rightly and properly, us it now appeared, they would have been perfectly content with what had been done for them and would have thanked their exacator for the administration of the estate which had been put in his charge.
