Water Police Constable Fodes, No. 181, was first called and stated that on the 16th inst, he was in charge of the first night watch aboard No. I police launch and proceeding along 9.30 p.m., just when the lanush was off Canton Wharf, witness saw a team-Jaunch approach ing on port hand. Then this witness saw the defendant strike the deceased two blows with his fist, follow ing these up by drawing his truncheon and dealing several flows with it on the deceased's chest and shoulders. He also poked him with the trunchoon, and kicked him in the region of the stomach. If the evidence of that witness could be believed, it would certainly appear that the defendant used unnecessary and unjustifiable violence. Of course, it was quite obvions that a police officer arresting a man must undebtedly nee what might be called a reasonable amount of compulsion to take that asan to the police station, and it would be for the jury to decide whether or not the defendant and overstepped that line. The police station was reached about half-past four in the afternoon, and the deceased was lodged in a cell. At five o'clock, half an hour afterwards, groans were heard proceeding from the cell. The noise increased, and on Inspector Macdonald, in charge at Yaumsti, making en- quiries, the deceased emitted a certain statement. He was removed at nine o'clock from the palice station to the Government Civil Hospital where Dr. Bell examined bfm, but could find no specific injury. At five o'clock next morning the deceased was in a state of collapse, and he died at nine o'clock, Dr. Bell's evidence at the Police Court was to the effect that there did not seemmuch the matter with the deceased when he was admitted to the hospital. At 1 am. ho complained of pains in the pit of the stomach, at 3 a.. he was in a state of oollapse, and at 9.30 am. he died. Dr. Bell made a post-mortem examination of the body. There were external marks or wounds, and the internal organs were al! healthy. The cause of death was check caused by rupture of the small gut. A kick on the abdomen might have produced those symptoms. Cross-ozamined by Mr. Master, Dr. Bal said that if the defendant had punched the deceased severely with his tran- cheon, he (Dr. Bally would live expected to find some external bruises. From the appearance of the body he should say that the deceased had not been severely struck on the chest and arms. That, concluded Mr. Pollock, was the whole atory of the charge against the prisoner. Whether or not that charge was substantiated by facts would be for the jury to decide when they had heard the evidence

Mr. Grist said he did not propose to call any witnessos, he would leave the decision entirely to His Worship, though he begged to submit that the last witness, the coxswain, did not know which way he went, us was shown by his con- fused evidence. There was no fault on the part of lus client.

M. R. C. WILCOX, who was elected to the chair, explained the purpose of the mosting and read the resolution to be confirmed. He cen cluded--Mr. Bennecks, the liquidater, has been enabled to obtain the signatures of by far the larger number of the shareholders, and has what he considers a sufficient majority. He will speak for himself.

Mr. BENNECKE-The only remark I have to make is that I could not find a single Chinese shareholder. Their addresses were not to be found, so I could not get their signatures to the agreement.
