The appeal being on a question of law, the following case was stated for the opinion of the Court:-
1. By a contract dated 25th March, 1808, the Plaintiff Soo Suai and one Peng Yam, who is alio Plaintiff in this suit.by the Official Trustee in Bankraptey, agreed with the defendants to build seven houses upon Kowloon Inland Lot No. 540 at and for the price therein stipulated and the Defendants agreed to pay to the plain- tiffs from time to time meh same as should be certified as dus by the architects employed by the Defendants to superintend the erection of the said houses.
2. Soo Sum and Pang Yam were partners for the purpose only of carrying out the said contract and as such partners assumed and used the name of the "Sing Kee contractors firm."
3. On the Urd February, 1890, one Chan Yiu Ting recovered judgment in the Supreme Court Summary Jurisdiction, against Pang Yam for the sum of $1,000 and costs.
The first question in the stated case must therefore, His Lordship held, be answered in the negative and that being so, the Judgment in the Court below must be reversed.

THE " 'FOOK SANG" PIRACY
CASE.
THE PRISONEES AT THE CRIMINAL SEBBIONY. At the Criminal Sessions yesterday, before Hin Honour Sir John Carrington, C.M.G. (Chief Justice), Mok So Wong Tai, and Li Yun were charged with (1) piracy; (2) robbery; (3) robbery being arted. They pleaded not guilty. The jurors were Mesra, E. G. Barrott, A. V. Apcar, F. Kiene, C. H. Lammert, F. Lemas, W. Moore, and C. S. Gabbay.
The Attorney-General (the Hon. W. Meigh Goodman) said that at about seven o'clock in the morning of the 13th May a steam 4. The Humphreys Estate and Finance Company, Limited, the present Defendants) portion of a certain Debt alleged now to te due from you to the said Defendant, viz., the sum of $1,100, being part of the sum of $49.00. being balance due by you to the Dofendut for the building of 7 houses on Kowloon Inland Lot No. 540 and that you, the said Humphreys Estate and Finance Company. Limitel, Lo and you are hereby prohibited and restrained until the further order of this Court from making pay ment of the said Debt or any part thereof to nay person whomsoevar,"
At the date of the said Prohibitory Order the sum of of $4,000, being the balance unpaid of the price stipulated in the aforesti contract, was due by the Defendants to Soe Sum and Pang Yum jointly for the building of 7 houses on Kowloon Inland Lot No. 540 and such sum was the property of the said Bing in respect of such building to Paug Yam NVerally,
7. On the 7th February, 1899, the grubitocts granted to Boo Sum suu Pang Yam a ertificate for $2.100. portion of the ninesid balance of $4,900, whereupon, the sun of 32.100, became immediately due and payable by the Defendante to Soo Sua and Fang Yan jointly.

9. The Defendante refused to pay $1,100 part of the raid sum of $2,100 to Soe Sum or to Fang Yam (or to Sen Sam and Pang Yum jointly) and on the 24th April, 1899, paid $1,000 to Sco Sun and Fang Yom jointly and paid $1,100 into Conrt under the aforesaid Prohibitory

10. The Defenitants alleged in their answer and tendered evidence at the hearing that in their belief there existed no actual partnership between Soo Sum and Pang Yam for the pur- poses of the said contract, but the Court held that such a partnership did in fact exist.
11. The said payment into Court was made voluntarily and not under pressure from the Court or its officers and Seo Bum protested against and was in no way a consonting party te such payment.
12. The Defendants claim that the said payment of $1.100 into Court under the said Prohibitory Order had then extact us payment of the said debt of $1100 to the persons entitled to receive the said debt, that is to say Soo Sum and Pang Yam.
