--"---

(Telegraph, April 11th.) Carl Lindgren, conriot, alias Jaan Luie, steward of the good ship Osprey, and James Brows eating-beuse keeper of Shadwell, allas Capain Brown, of the Brazilian meronutile Infine, were yesterday afternoon sentenced by mr. Fintice Brett, the former to saver, and the latter to five years' penal servitadetlie fust that the eating-house keaper, anlike his dom panion in trouble, bad not been previously con victed, being allowed to tell in bis favour. In neither case will the seriasos appear too harsh if the serious nature of the ering of which the two misdemeanants were found guilty bo taken into antidiens nocount. As Mr. Justin Brett pointed out, to the jury, Arthur Orton bad, in the parauit of his wicked fraud, one great dill. guity to contesd with. It was admitted on all bands thats in the early part of the year 1854, Roger Tichborne had ended in the Bella from His for New York, and that the Bella hud The ponvict Orton, however, persisted in alleging that Roger Tiol borre and some three or four of the Beire crew wers saved from the foundered vessel in a little open boat; that thoy, drifted about for several days at aca, suffering terrible privationa; and that at last they were picked up by a ship called the Osprey, and earried into Melbourne. Then was obviously no prind facie improbability in this story, the difficulty was that it stood ab solutely-unsupported, upon the then Claimant's bara sertion. No one of the sailors who according to his own sccnimt, were rescued with him, the of the cres from the vesse -tat rescued shew-cano_forward to expport his stury; nor was any record or even travo of the good ship Deprey to to found oither ut Melbourne or in Amerion. Accordingly, when Arthar. Orton bed to take his riul for corrupt and wilful perjury, it was felt by those who surrounded, alvised, and support ed in that evidence was imperatively weed- ed to bridge over this otherwies fatal gap. Could proof be offered to the jury in "Iegina v. Osatro" that a verse called the Osprey bad netnally, in the year 1854, picked up some any vivors of the Bello, and amongst them a young Englislauso, and carried them into Melbening, then the rest of the defendant's story would become at once so far probable as to render bia nequitial almost inevitable. The point oase conceded that Roger Ticilorne wasrooned from be Bella and inde 1 in Melbourne, all else would follow almost ne a matter of course. Indeed, we do not hesitate to assert car conviction that bad the evidence given by Luis and Brown in the Court of Queen's Bench remained as all bat happened-obstantially uncontradicted, not only would Ambur Orton-have been nequit sed, but funds would have been almost imme. diately forthcoming in support of another nefarious attempt to rok, the infant son of the late Sir Alfred Ticbburas of his title and estates. Thus the so-called "Claimant was from the very dirat surtounded by a crew of adventurers and speculators, who had a direct penniary interest in the anocess of his abonii. nable frand, is, unfortunately, mates of COMMERCIAL INTELLIGENOE. -- notoriety. Thean øjen, whoover they were, agre evidently not over-acropaluus. Moary there was, to a certain extent; and in no way could is by better, spent than in procuring some Bort of ovidmce of the Osprey's existence and the rescue of the Bella's crew. Could a genuine surprise be affected could an Osprey man be "sprung anon" the jury so suddenly as to giva no Line to inquire into bis antecedents, or to sift hie stary-all might go well, even at ths eleventh hour, and the financing" of "Sir Hoger might still prove to be a more pro file speonlation than it bad tooted when Lord Chief Justice Bovril signed the warrant for Arther Orton's committal,

The evidouce given by "Jean Luia" and Captain Brown must all be fread in the memory of our readers. Indeed, few are likely to have forgotten how the evidence of the oot vint Landgren rock almost all England by stirprise, and Jonio eta True?" will probably remain a by-word for years to couno, Stopping Coldly into a box, Lundgren swaro that de was, in 1804, stoward on board the Osprey, a large three-masted vessel, bound, for Melbourne from New York that off the count of the Brazils they sighted an open boat, iz wbigli, with one or two other men, was a young Eng- list.man who called bimecit Mr. Rogers that that same young Englishman be," "Lais, saw rain before him, non recognised, in the person of the Claimant to the Tieltors, se- Intce, the the Osprey in due course arrived at Meibomne, and that there Mr. Rogers" landel. Saut were; in effect, the cutlines of Jean Luio's Buriative, although it was given with an ucouricy of detail that was almost marvellogs. Not a point fa thà original story of his rescue, as told by Arthur Orton, was forgotten or miss- ed. The red shirt beld up on the car, slie brown mark on the side, the "Garden of the Soala these and dozens of other telling and deftly azringedincidents were fitted into toe testimony

Mr. Thurlow Weed, wao is himself an old man, adde his testimony uguinst those who carry the argoment to such an extrenio as to deny that men can livo to be more than 100 years old. The first instance ou Mr. Wecd'alisis that of M George Labar, of Monroe county, in this State, who is 112 years old, the second is Mr. George Trivic, of Daleville, nec in Peutsylvania, the oldest hotel proprietor in the State, he being 109 years old; and the third is Capt, Latebuab, of New York, who is over 108 years old. The latter was engaged in the servico of the Eust India Company more than 75 years ago, and public recorda leave to doubt of bis age.
