Company fined for tax offence
A company was fined $10,000 by the Eastern Magistracy today (Wednesday) after pleading guilty to failing, without reasonable excuse, to notify the Commissioner of Inland Revenue in writing of the departure of an employee from Hong Kong.
The defendant, Bozell Limited, employed and paid salary to a senior employee during the period from September 3, 1990 to August 31, 1994. However, the defendant failed to give advance notice to the Commissioner of Inland Revenue regarding the employee's departure from Hong Kong and to retain payment of money or money's worth due to the employee as required under the Inland Revenue Ordinance.
As a result, the Commissioner of Inland Revenue is unable to recover salaries tax due from the employee.
