New appeal mechanism for public housing tenants
The Housing (Amendment) Ordinance 1995 and the Housing (Tenancy Appeals) Rules gazetted today (Friday) will provide, as from tomorrow (July 1), a new appeal mechanism for public housing tenants.
Under the Ordinance, the Secretary for Housing, Mr Dominic Wong, will appoint an Appeal Panel to hear appeals against decisions of the Housing Authority to terminate leases or give notices to quit. Procedures for hearing appeals are stated in the new Rules.
"The main objective is to ensure that every appeal is handled in a consistent, efficient and impartial manner," Mr Dominic Wong said. "Membership of the Appeal Panel will be announced shortly."
The Ordinance will also deter the creation of unauthorised mortgages or charges on Home Ownership Scheme and Private Sector Participation Scheme flats by making them legally void and rendering offenders liable to prosecution.
Other provisions in the Ordinance will clarify the Housing Authority's power to employ staff and consultants, and will streamline the delegation of administrative responsibilities by the Director of Housing to Housing Department officials.
