TOUGHER FINES FOR NOISE OFFENCES FROM NEXT MONTH

THE GAZETTE ANNOUNCED TODAY (FRIDAY) THAT THE MAXIMUM FINES FOR VARIOUS NOISE OFFENCES WOULD BE DOUBLED FROM NEXT MONDAY (AUGUST 1).
THE ACTING ASSISTANT DIRECTOR OF ENVIRONMENTAL PROTECTION, MR RAYMOND LEUNG, SAID THE INCREASE OF FINES WAS MADE UNDER SECTION 9 OF THE NOISE CONTROL (AMENDMENT) ORDINANCE 1994 AND THE NOISE CONTROL { AMENDMENT) GENERAL REGULATIONS 1994.
HE SAID: "IT IS NECESSARY TO DOUBLE THE MAXIMUM FINES BECAUSE THE CURRENT LEVEL OF FINES HAS PROVED TO BE GENERALLY INADEQUATE TO DETER NOISE OFFENDERS."
UNDER THE AMENDED ORDINANCE AND REGULATIONS, THE MAXIMUM FINES FOR COMMITTING NEIGHBOURHOOD TYPE NOISE OFFENCES, SUCH AS THOSE INVOLVING BLASTING LOUD MUSIC IN DOMESTIC PREMISES AND PUBLIC PLACES, WILL BE INCREASED FROM $5,000 TO $10,000.
THE MAXIMUM PENALTY FOR CARRYING OUT WORK WITHOUT A CONSTRUCTION NOISE PERMIT, OR VIOLATING CONDITIONS OF IT, WILL BE INCREASED FROM $50,000 TO $100,000 ON FIRST CONVICTION AND $100,000 TO $200,000 FOR REPEATED OFFENCES.
MEANWHILE, THE MAXIMUM FINES FOR NOT COMPLYING WITH THE REQUIREMENTS OF A NOISE ABATEMENT NOTICE FOR INDUSTRIAL AND COMMERCIAL TYPE NOISES, ARE ALSO INCREASED FROM $50,000 TO $100,000 ON FIRST CONVICTION AND $100,000 TO $200,000 FOR SUBSEQUENT CONVICTIONS.
"JT IS HOPED THAT THE INCREASED FINES WILL HAVE A GREATER DETERRENT EFFECT ON NOISE OFFENDERS AND RESULT IN A LESS NOISY ENVIRONMENT FOR HONG KONG PEOPLE,' MR LEUNG SAID.
