NEW LAW PROVIDES EMPLOYEES BETTER PROTECTIONS

THE ASSISTANT COMMISSIONER FOR LABOUR, MR ALFRED CHAN, TODAY (FRIDAY) REMINDED EMPLOYEES WHO WERE UNABLE TO CONTINUK THEIR EMPLOYMENT WITH THEIR EMPLOYERS AND CLAIM LONG SERVICE PAYMENT ON GROUNDS OF ILL HEALTH THAT THE MEDICAL CERTIFICATION PROCEDURES

HAD BEEN SIMPLIFIED.

CHAN SAID UNDER THE EMPLOYMENT (AMENDMENT) ORDINANCE 1993 WHICH WAS APPROVED IN THE LEGISLATIVE COUNCIL ON WEDNESDAY AND GAZETTED TODAY, ANY MEDICAL PRACTITIONER REGISTERED UNDER THE MEDICAL REGISTRATION ORDINANCE WOULD BE ALLOWED TO ISSUE THE CERTIFICATE.

PREVIOUSLY, AN EMPLOYEE MUST BE CERTIFIED BY A MEDICAL PRACTITIONER PRACTISING IN A GOVERNMENT, GOVERNMENT-SUBVENTED OR PUBLIC HOSPITAL AS PERMANENTLY UNFIT FOR THE TYPE OF WORK HE 19 PERFORMING, HE SAID.

"IF THE EMPLOYER IS NOT SATISFIED WITH THE MEDICAL ASSESSMENT MADE BY THE EMPLOYEE, HE MAY, AT HIS OWN EXPENSE, APPOINT ANOTHER MEDICAL PRACTITIONER TO REASSESS HIS EMPLOYEE'S MEDICAL CONDITIONS.

"SHOULD THE MEDICAL OPINIONS OF THE TWO ASSESSMENTS BE IN CONFLICT, THE CASE MAY BE REFERRED TO THE COMMISSIONER FOR LABOUR FOR DETERMINATION, MR CHAN ADDED.

HE SAID THE AMENDMENT ORDINANCE ALSO PROVIDED BETTER PROTECTION TO AN EMPLOYEE WHO HAD GIVEN EVIDENCE OR INFORMATION AGAINST HIS EMPLOYER то THE AUTHORITIES CONCERNED IN CONNECTION WITH THE ENFORCEMENT OF THE EMPLOYMENT ORDINANCE OR BREACHES OF WORK SAFETY REGULATIONS.

THE LEGISLATION EMPOWERS THE COURT OR MAGISTRATE TO ORDER THE EMPLOYER TO PAY COMPENSATION TO HIS EMPLOYEE SHOULD HE BE CONVICTED.

THE COMPENSATION WILL BE IN ADDITION TO ANY FINE IMPOSED BY THE COURT OR THE MAGISTRATE, MR CHAN ADDED.

ANOTHER NEW MEASURE STIPULATED IN THE ORDINANCE RELATES TO THE

LAY-OFF PROVISIONS.
