PROTECTION OF WORKERS IN RELOCATION OF WORK PLACE ADEQUATE
AN EMPLOYEE WOULD BE CONSIDERED ΤΟ HAVE BEEN CONSTRUCTIVELY DISMISSED AND BE ENTITLED TO SEVERANCE PAY IF THE CHANGING OF THE PLACE OF WORK ANYWHERE WITHIN THE TERRITORY CAUSES SO MUCH HARI'SHIP AS TO MAKE IT IMPOSSIBLE FOR HIM TO CONTINUE WITH THE EMPLOYMENT.
THIS WAS STATED BY THE SECRETARY FOR EDUCATION AND MANPOWER, THE HON MICHELANGELO PAGLIARI, IN A WRITTEN REPLY ΤΟ A QUESTION THE HON TAM VIU-CHUNG.

THE ORDINANCE, WHICH SAID THAT EMPLOYEES WOULD BE REGARDED AS HAVING DISMISSED BY REASON OF REDUNDANCY AND BE ENTITLED ΤΟ SEVERANCE PAY IF"THE REQUIREMENTS OF THAT BUSINESS FOR EMPLOYEES TO CARRY OUT WORK OF A PARTICULAR KIND IN THE PLACE WHERE THE EMPLOYEE WAS SO EMPLOYED HAVE CEASED OR DIMINISHED OR ARE EXPECTED TO CEASE OR DIMINISH".
HE SAID ADEQUATE PROTECTION WAS THEREFORE
AVAILABLE TO THE
EMPLOYEES IN QUESTION.

FOR THE PURPOSES OF THE CRIMINAL LAW, THERE WERE A VARIETY OF DIFFERENT AGES AT WHICH YOUNG PERSONS WERE HELD BOTH ΤΟ BE RESPONSIBLE FOR THEIR OWN ACTIONS AND ΤΟ REQUIRE PROTECTION, THE ATTORNEY GENERAL, THE HON MICHAEL THOMAS, TOLD THE LEGISLATIVE COUNCIL TODAY (WEDNESDAY).
"THESE AGES WILL VARY ACCORDING TO THE DIFFERING CRITERIA WHICH THE UNDERLYING POLICY ADOPTS TO ACHIEVE AIMS," HE SAID.

BUT HE SAID THIS APPROACH BEST ENABLED THE CRIMINAL LAW TO DEAL JUSTLY WITH THE WIDE VARIETY OF OFFENCES AND SITUATIONS INVOLVING YOUNG PEOPLE.
FOR EXAMPLE, A CHILD UNDER SEVEN WAS NOT CAPABLE OF COMMITTING AN OFFENCE AT ALL AND A PERSON BETWEEN THE AGES OF SEVEN AND 14 WAS PRESUMED NOT TO HAVE FORMED THE NECESSARY INTENT TO COMMIT AN OFFENCE, HE ADDED.
