THE GROUP WAS FORMED BY THE DISTRICT BOARD TO EXAMINE MANAGEMENT PROBLEMS AND TO MAKE RECOMMENDATIONS ON IMPROVING THE ENVIRONMENT AND SECURITY OF BUILDINGS IN THE DISTRICT.
THE GROUP FOCUSED ON THREE ASPECTS IN STUDYING THE BUILDING: THE DEED OF MUTUAL COVENANT, ILLEGAL STRUCTURES AND MANAGEMENT AFFAIRS.
LIMITED POWERS AND FINANCIAL CONSTRAINTS ON THE PART OF OWNERS INCORPORATIONS AND THE LACK OF EFFECTIVE LEGISLATION POSED DIFFICULTIES, THE GROUP REPORTED.
IT SUGGESTED THAT A DEED OF MUTUAL COVENANT SHOULD GIVE A BUILDING'S OWNERS INCORPORATION THE RIGHT TO TAKE UP MANAGEMENT OF COMMON AREAS WHICH BELONGED TO THE DEVELOPER.
LEGISLATION SHOULD BE ENACTED TO ALLOW A DEED TO BE AMENDED F JUSTIFIED AND AGREED TO BY 90 PER CENT OF THE OWNERS OR BY 75 PER CENT OF THE OWNERS IN THE CASE OF A NEW BUILDING,
THE CROWN LAND RESUMPTION ORDINANCE SHOULD ALSO BE AMENDED TO ALLOW THE GOVERNMENT TO RESUME IMPROPERLY MANAGED PRIVATE REAR LANES TO IMPROVE MAINTENANCE AND TO ENSURE HYGIENIC CONDITIONS PREVAILED.
THE REPORT SUGGESTED THAT THE OWNERS INCORPORATION SHOULD HAVE POWER TO REMOVE ILLEGAL STRUCTURES, AND BE PROVIDED WITH LEGAL ADVICE AND FINANCIAL ASSISTANCE BY THE GOVERNMENT IN THIS RESPECT.
ON GENERAL MANAGEMENT, THE REPORT SAID THE SETTING UP OF A BUILDING MANAGEMENT CO-ORDINATION TEAM IN MONG KOK WOULD ASSIST OWNERS INCORPORATIONS AND MUTUAL AID COMMITTEES IN TACKLING MANAGEMENT PROBLEMS.
A SPECIAL TRIBUNAL SHOULD ALSO BE SET UP TO HANDLE CLAIMS AGAINST TENANTS CONCERNING BUILDING MANAGEMENT AND MAINTENANCE FEES. AT THE SAME TIME, THE GOVERNMENT SHOULD CONSIDER SIMPLIFYING THE LEGAL PROCEDURES CONCERNING SUCH CLAIMS.
THE REPORT CALLED FOR MORE BUILDING MANAGEMENT COURSES TO BE ORGANISED TO EXPLAIN RELEVANT REGULATIONS AND UP-TO-DATE MANAGEMENT SKILLS TO OFFICE-BEARERS OF OWNERS INCORPORATIONS.
IT NOTED THAT BUILDING MANAGEMENT WAS ONE OF THE MAIN SUBJECTS
OF PUBLIC CONCERN AND COMPLAINT IN THE DISTRICT.
DURING THE LAST FINANCIAL YEAR, THE TWO PUBLIC ENQUIRY COUNTERS OF THE DISTRICT OFFICE HANDLED NEARLY 6 000 ENQUIRIES ON BUILDING MANAGEMENT MATTERS.
OVER 300 COMPLAINTS WERE RECEIVED BY STAFF OF THE DISTRICT OFFICE AND ANOTHER 71 CASES WERE REPORTED TO THE DISTRICT BOARD.
THE REPORT OBSERVED THAT AMONG 1 800 PRIVATE MULTI-STOREY BUILDINGS, ABOUT 200 DESERVED ATTENTION.
