ID CARD REMINDER TO EMPLOYERS

THE LABOUR DEPARTMENT TODAY REMINDED EMPLOYERS AND EMPLOYEES OF THEIR OBLIGATIONS FROM MONDAY (NOVEMBER 3) UNDER THE NEW
IMMIGRATION ORDINANCE.
FOR EMPLOYERS, IT WILL BE AN OFFENCE AS FROM MONDAY TO HAVE IN THE IR EMPLOY ANYONE WHO DOES NOT HAVE AN IDENTITY CARD OR OTHER SPECIFIED PROOF OF IDENTITY, A SPOKESMAN FOR THE DEPARTMENT SAID.
THOSE WHO TAKE ON PEOPLE WITHOUT ID CARDS, OR AN APPROPRIATE ALTERNATIVE DOCUMENT, WILL BE LIABLE TO A FINE OF UP TO $50 000 AND IMPRISONMENT FOR ONE YEAR, HE WARNED.
EXISTING EMPLOYEES, THE SPOKESMAN SAID, ARE REQUIRED BY LAW TO PRODUCE THEIR ID CARD, OR APPROPRIATE ALTERNATIVE DOCUMENT, FOR INSPECTION BY THEIR EMPLOYERS BY MONDAY.
+FAILURE TO DO SO RENDERS AN EMPLOYEE LIABLE TO DISMISSAL WITHOUT NOTICE AND WITHOUT PAYMENT IN LIEU, HE WARNED.
THE SPOKESMAN NOTED THAT EMPLOYERS WERE ALREADY REQUIRED SINCE OCTOBER 28 TO INSPECT THE ID CARD, OR AN ACCEPTABLE ALTERNATIVE DOCUMENT, OF ANY NEW APPLICANT BEFORE OFFERING EMPLOYMENT.
FROM MONDAY, EMPLOYERS ARE ALSO REQUIRED BY LAW TO MAINTAIN UP-TO-DATE RECORDS OF THEIR EMPLOYEES SHOWING THEIR NAMES AND PARTICULARS OF THE IR IDENTITY DOCUMENTS.
UNDER THE IMMIGRATION ORDINANCE AN EMPLOYEE MUST HAVE AN ID CARD OR PROOF OF AN APPLICATION FOR REGISTRATION OR REPLACEMENT, OR IF HE IS NOT REQUIRED TO BE REGISTERED UNDER THE REGISTRATION OF PERSONS ORDINANCE, HE SHOULD HAVE A VALID TRAVEL DOCUMENT, OR A VIETNAMESE REFUGEE CARD, OR A CERTIFICATE OF EXEMPTION ISSUED TO THE AGED, THE BLIND AND THE INFIRM.
