REMINDER ON STATUTORY HOLIDAY PAY FC.. WORKERS ******

THE DEPUTY COMMISSIONER FOR LABOUR HR. NEIL HENDERSON TODAY REMINDED EMPLOYERS OF THEIR OBLIGATION UNDER THE EMPLOYMENT. ORDINANCE TO GIVE STATUTORY HOLIDAY PAY TO EMPLOYEES.

+THERE ARE SIX STATUTORY HOLIDAYS IN A YEAR THE FIRST DAY OF JANUARY, LUNAR NEW YEAR'S DAY, THE SECOND DAY OF LUNAR NEW YEAR, CHING MING FESTIVAL, TUEN NG FESTIVAL, AND THE DAY FOLLOWING THE CHINESE MID-AUTUMN FESTIVAL, ALL NON-MANUAL [MPLOYEES EARNING NOT MORE THAN $2,000 A MONTH AND ALL MANUAL WORKERS IRRESPECTIVE OF THEIR EARNINGS ARE ENTITLED TO THE HOLIDAY.

+AND THEY MUST ALSO BE PAID FOR THE DAY OFF IF THEY HAVE WORKED CONTINUOUSLY FOR THEIR EMPLOYERS FOR THREE MONTHS IMMEDIATELY PRECEDING THE STATUTORY HOLIDAY, MR. HENDERSON SAID.

+FAILURE TO GRANT HIS EMPLOYEE ANY STATUTORY HOLIDAY OR TO GIVE HIM THE HOLIDAY PAY DUE WILL RENDER THE EMPLOYER LIABLE FOR PROSECUTION.+

MR. HENDERSON WAS COMMENTING ON A RECENT CASE IN NORTH KOWLOON COURT WHEN MAGISTRATE, MR. M.H.B. NEWELL, FINED A KOWLOON TEXTILE FACTORY A TOTAL OF $4,800 FOR FAILING TO GIVE STATUTORY HOLIDAY PAY TO FIVE EMPLOYEES ON 24 OCCASIONS.

IN ADDITION TO THE FINES, THE COURT ALSO ORDERED THE COMPANY TO EFFECT PAYMENT OF OUTSTANDING HOLIDAY PAY AMOUNTING TO $549.10 TO THE FIVE EMPLOYEES.

MR. HENDERSON ADDED THAT THE PROVISIONS OF THE EMPLOYMENT ORDINANCE APPLIED NOT ONLY TO INDUSTRIAL EMPLOYEES BUT ALSO TO EMPLOYEES IN THE ENTIRE COMMERCIAL SECTOR, INCLUDING THE SERVICES AND CATERING TRADES.
