        "content_text": "General\n\nUpon review of this case, the evidence of the Surveyor General and officers of his department acting for the Crown shows that any proceedings are to be termed ill-advised; they must be the proceedings of the Court in going against the plaintiff's power to execute without directions. Without being sworn upon oath, a Decree was made, which had the effect of Defendant; despite the evidence of Lieutenant Johnstone, the specially appointed Surveyor of the fort, as well as the affidavits sworn to by the Surveyor General.\n\nI also much regret that I cannot view this case in the same light as His Excellency. An offer of a sum of money, representing the market value of a piece of ground sold by the Government as compensation for damages sustained by W Stapleton, was made due to the conflict between departments. And if the Government chooses to stand by their act and allows Crown Land to be taken away from Crown lessees in this manner without taking their protections, ... \n\nI strongly consider that the least the Government can offer to do is to give full compensation to the aggrieved party for all the losses sustained.\n\nI trust therefore that His Excellency will consider the case further.",

I desire to express my thanks to the Commissioners for their valuable work, with its resultant addition of no inconsiderable force for service with His Majesty's Armies; work which has, to my personal knowledge, involved much patient labour.\n\n3. With reference to paragraph 8 of the report I propose shortly to make a pronouncement in the Legislative Council regarding the subject of Military Service in relation to this Colony.\n\n4. An unexciting game resulted. The civilians were all out for 98 but the Army could not succeed in reaching that not very high water mark of achievement by nearly 20 runs.         "content_text": "# THE HONG KONG WEEKLY PRESS & \n\n## Shareholders' Meeting\n\nThe disappointing year just passed. We share with you the hope that during the present year there will be such a revival of trade as will justify the continuance of the same level of return to Shareholders as is now recommended, and that the warning you give that without that revival, the high level of past years may not be possible will be found to have been unnecessary.\n\n## Customs\n\nReference is made to the Chinese Maritime Customs returns of last year at over 82 million Haikwan Taels, being a rise of 13 millions over the previous year. Although constituting record and remarkable figures, these should not be exaggerated for the reasons you have given; furthermore, unless and until there is clear evidence that merchandise is moving into the interior markets of China it cannot be confidently asserted that a period of prosperity is immediately at hand, but, given a fair measure of political stability in China throughout the year, with continued industrial peace at Home and in Europe generally, and the faithful carrying out of the new Customs tariff without the imposition of any further vexatious taxes on Imports, the coming year should show a considerable improvement on past years, and bring a much needed relief to both Chinese and foreign merchant firms.\n\nOne of the most gratifying features of the speech is the pronouncement that the anti-British agitation of two or three years ago has practically vanished, and that a new spirit of friendliness is now making itself felt. I am inclined to say rather that the old spirit of friendliness is becoming more apparent. Whichever it be, we are in entire agreement that we are much indebted to H.M. Representative in Peking, and, as regards Canton and South China, to H.E. the Governor of Hong Kong. We congratulate the Directors and Chief Manager on the opening of the Kowloon Sub-Agency, which, I am sure, will be of service to the ever-increasing population on the mainland. For my own part, I am sufficiently optimistic of the future of Kowloon to predict that before many years, it will be necessary to have our own premises.\n\nI am sure this meeting will confirm the action of the Directors in voting the bonus of 10 per cent. on the salaries to the staff. If the Bank's staff in all its branches are as hard worked as they are at Head Office, they well deserve this recognition of good service.\n\nI cannot do better than conclude my remarks by quoting from the address of the Rt. Hon. Mr. Reginald McKenna at the recent general meeting of the Midland Bank in London. His remarks, I think you will agree, are peculiarly appropriate to conditions obtaining in China at the present time: \"Ten years have passed since the conclusion of the most recent and, we devoutly hope, the last, great war in the world's history. They have constituted a decade of grave difficulties involving problems of exceptional magnitude and complexity. Disappointments have been frequent and many setbacks have been suffered. Peace between nations and within nations is a primary condition to our welfare, and whatever the temporary state of trade, however slow we are in solving the financial and industrial problems which confront us, we shall look forward with unshakable confidence to the time when the better relationships now established shall become the foundation of general and permanent well-being.\" Mr. Chairman and Gentlemen, I have very much pleasure in seconding the adoption of the report and statement of accounts.\n\nThe motion was carried.\n\n## OTHER BUSINESS\n\nMr. H. R. B. Hancock proposed that the appointments of Messrs. A. Plummer, B. D. F. Beith, and B. Lander Lewis be confirmed and that Messrs. H. P. White, T. G. Weall, and W. H. Bell be re-elected Directors. Mr. K. S. Morison seconded, and the motion was carried.\n\nMr. J. H. Taggart proposed that Mr. C. Bernard Brown and Mr. John Fleming be re-elected Auditors. Mr. E. L. Sim seconded, and the motion was carried.\n\nThis was all the business, and the Chairman announced that dividend warrants would be ready on Monday.\n\n## EXTRAORDINARY MEETING\n\nSubsequently, an extraordinary general meeting was held, at which the resolution passed at the meeting of February 2nd was confirmed.\n\nThe Chairman proposed the confirmation of the resolution, which was seconded by Mr. T. Ellis.\n\n## CORRESPONDENCE\n\n### THE FLYING CLUB\n\nTo the Editor of the Daily Press.\n\nHong Kong, February 24th.\n\nSir,—At the Hong Kong University on the evening of the 22nd, I was able to announce that Chinese members would be welcomed in the Scapone Club. This is a very important step in the history of the Club, and I feel that the Club's future is an assured success.\n\nIt will be remembered that in September last, a small \"Working Committee\" was formed to carry out the preliminary organisation. The Committee now desire to complete that organisation and bring the Club to active existence. To do this, it is necessary to communicate with people who are interested, so I would request all those who would like to join the Club or support the movement, although they may not wish to fly themselves, to write to me as soon as possible. In particular, I wish to hear from the Chinese residents in the Colony, and it would greatly assist me and the Committee if one or two Chinese gentlemen would come forward with an offer to assist in the preliminary organisation. Letters expressing interest or a desire to join the Club will not commit the writer; they will only cause this name to be placed on the Club register, so that the organisers can circularise the right people.\n\nIt is expected that a meeting will be held in March, when the final Rules and Regulations can be discussed, and a Committee selected. I would therefore request that replies be forwarded as soon as possible.\n\nI take this opportunity of explaining that Members who join the Club to learn to fly would be taught by a fully qualified Instructor, and that \"Associate Members,\" that is, those who do not actually wish to learn to fly, but wish to support the Club, will be able to obtain flights at a small cost.\n\nSir Robert Ho Tung has requested me to enter his name for the \"Associate Member\" Club, and I think that many well-known residents will follow his excellent example in the course of the next few days.\n\nIf there is any lady or gentleman who would like to support the Club with the gift of an aeroplane, I shall be pleased to discuss this with them. Hynes.\n\nWhilst we, as shareholders, must regret that the sterling bonus for the year has been reduced from £2 to £1 per share, we feel bound to quiesce in the decision of the Board when we reflect that, at the low exchange of 1s/7½d to the dollar, the final payment to us of £4 per share costs only about $40,000 less in dollars than the payment of the final of £5 per share cost us for the year 1928 at the then exchange of 2s. 04d. to the dollar. Moreover, those shareholders, who think in dollars, can derive comfort from the fact that for the year 1929 they are receiving, in dividend and bonus combined, $80.37 per share as compared with $79.02 per share for the year 1928.\n\nThree years has been Chief Manager. These three years, as you all know, have been exceptionally difficult ones, and the results at face of these difficulties speak more for Mr. Hynes' zeal and ability in the service of the Bank than anything I could possibly say.\n\nI feel sure that you would wish to join me in offering a warm farewell to Mr. Hynes and in wishing him enjoyment of a well-merited rest after his long and successful career in the Bank.\n\nAnother old colleague of mine, Mr. V. M. Grayburn, has been appointed to be Acting Chief Manager when Mr. Hynes leaves in two or three weeks' time. Here again I feel sure that you will join me in offering him a hearty welcome and every success.\n\nIn regard to the disturbed state of affairs in China, shareholders can only join with our Directors in deploring the continued persistence of civil war in China with its accompaniment of famine and brigandage and of the oppression of the Chinese merchants and masses by irregular taxation and interference with the arteries of trade in so many Provinces of China.\n\nAlso the molestation of shipping by pirates is still unfortunately with us, and we trust that the preventive measures, which have recently been initiated by the Government Kwangtung, will shortly bear fruit.\n\nIn conclusion I would ask you to confirm the Directors' vote of a bonus to the staff of 5 per cent. on their salaries. In rising to second the adoption of the Report and the Statement of Accounts, I do not propose to occupy many minutes of your time, especially in view of the very full and interesting speech which has just been made from the chair.\n\nThe first point which strikes one as satisfactory is the fact that, in spite of difficult trade and banking conditions during the past year, our earnings in silver for 1929 exceeded by some seven lakhs of dollars our earnings in silver for the year 1928.\n\nYet another point for congratulation is that our Directors by transferring 5 million dollars from our silver reserve at the very favourable rate of 2/- to the dollar, have raised our sterling reserve to six and a half millions sterling, and when we call to mind that only 10 years ago, at the beginning of 1920, our sterling reserve stood at one and a half million pounds only, it will be readily appreciated how much the Bank has strengthened its sterling position during the last ten years.\n\nWe are also transferring $500,000 to our silver reserve and $750,000 to Bank Premises Account; and it is pleasing to hear from you, sir, that our investments stand at well under market quotations.\n\nExtrality Abolition.\n\nAs regards the abolition of extrality, one can only express the hope that the powers-that-be in Nanking will realize the desirability for proceeding slowly and gradually, so long as Chinese Judges have no security of tenure of office, and so long as such Judges are liable to dictation and interference by political and military officials.\n\nAll shareholders will most cordially indorse the bonus of 5 per cent. to the Bank staff on their salaries, and will very much regret the necessity for reducing the same.\n\nIn conclusion, Mr. Chairman, I desire, on behalf of the shareholders, to echo your words of appreciation of the very valuable services which have been rendered to the Bank by retiring Chief Manager, Mr. Hynes, during the past three extremely difficult years, and we join in wishing him, and Mrs. Hynes also, many years of happiness to come.\n\nWe likewise desire to endorse your words of welcome to the incoming Chief Manager, Mr. Grayburn, and to wish him every success in his arduous task.\n\nThe report and accounts were unanimously adopted.\n\nBusiness Matters.         "content_text": "Page Two\n\n75\n\nEDUCATION DEPARTMENT,\n\nHONG KONG.\n\n(5)\n\nWith regard to your paragraph 4 the oversea allowance and the charge allowance are at a fixed rate, i.e. £100 oversea allowance and £150 charge allowance for men and £70 oversea allowance and £150 charge allowance for women. There is no sliding scale for charge allowance or oversea allowance. The amounts shown as increases in the detailed statement attached to the Governor's Savingram No.120 of 14th March represent the net increase over the maximum of £600 per annum. In illustration take the case of Goodban whose present salary on the amended Code would be £510 plus £150 charge allowance plus £100 oversea allowance. The addition of charge allowance alone brings his salary to £660, i.e. £60 above the £600 which he would get on the old scale. This is shown as Increase due to charge allowance £60 in paragraph B (a). The oversea allowance of £100 increases the total salary over the £600 maximum by a further £100. In the case of Miss Hurrell her salary on the amended scale is £456 and with the addition of £150 for charge allowance becomes £606 over the maximum of £600 and oversea allowance makes £70 further increase.\n\nI hope this is sufficiently clear to explain the varying figures in the increases due to charge allowance and oversea allowance.\n\nI am as shown in the detailed statement of revised expenditure. Attaching to this letter a statement of the position together with a complete list of all those who have been assessed on the Burnham Scale. Their names are prefaced with letters in red ink which signify:-\n\nC - Charge allowance.\n\nO - Oversea Allowance.\n\nM - Married.\n\nL - Locally domiciled.\n\nR - Member of religious order.\n\nM, L, and R do not qualify for oversea allowance.\n\nThe situation is further complicated by the fact that two Headteachers are not qualified for the Burnham Scale and, being locally domiciled, receive only £150 charge allowance. They are Mrs. W.K.Cheung, Headmistress of Heen Tunn School and Fr. Tim Hoy Lan, Headmaster Wah Yan College, Kowloon.\n\nIn the original lists (a) and (b) only those who, on receipt of the proposed allowances, would obtain salaries greater than £600 per annum were included. Stapleton has a salary at present of £480 which with the £100 oversea allowance brings him to £580, involving no increase.\n\nSmith is a similar case. Both, however, would gain salaries above £600 when on the maximum and are therefore included in list (b) only.\n\nIn the case of Goodban, on account of the courses he took during training and his qualifications, his salary was assessed at £510 by £15 to £600 and this figure would be covered by an amended para.10 as suggested earlier.\n\nI hope that this will resolve the difficulties set out in your letter.\n\nYours sincerely,\n\nI.R.Rowell.\n\nJ.
