        "content_text": "Your Petitioners have been unable to obtain a copy of the witness statements referred to in the enquiry, which has made it difficult for them to thoroughly understand the whole position for the purposes of this Petition.\n\nYour Petitioner has no personal feeling against the Captain Superintendent of Police and is not imputing to him any unfairness, though strongly protesting against the methods which allowed a man to be broken on an enquiry held in such a manner.\n\nNow, if the proceedings were conducted by the strict letter of the law, which, as Your Petitioner is convinced, is doubtful, Your Petitioner submits that it is unconstitutional and inequitable that the prosecutor should preside over such an enquiry, and that the President should be an impartial person who could hear evidence on both sides with the assistance of trained lawyers, so that the full benefit of cross-examination might be obtained.\n\nYour Petitioner had the opportunity of questioning the witnesses, it is true, but he was not allowed to take notes because he was standing to attention before the Captain Superintendent, and no writing materials were offered to him, nor was he allowed to take notes during the enquiry. The Captain Superintendent ordered him to stand in a particular place during the enquiry.\n\nYour Petitioner says that the withholding of the evidence and the lack of opportunity to take notes were inequitable and unfair.\n\nFurther, Your Petitioner's legal advisers would point out that a person committed for trial on a charge of murder is entitled to a copy of the depositions on which he is committed.\n\nA copy of Your Petitioner's Statement of Defence handed to the Captain Superintendent of Police during the enquiry is contained in the Fourth Schedule.\n\nYour Petitioner was not dismissed for bribery. There was a suggestion of it in the evidence given by Sham In, a convicted gambler, who gave evidence for Your Petitioner, which, as far as Your Petitioner is aware, is absolutely false.\n\nThis witness, Sham In, further said that the expression \"Dai Lau\" referred to Your Petitioner. Your Petitioner believes that this expression, as used by the witness, did not refer to him. The term \"Dai Lau\" is a term used in more than one sense.\n\nYour Petitioner refers to an enquiry recently held by the Captain Superintendent to enquire into a charge against Mr. Angus McIntyre. A Chinese witness examined by Sergeant McIntyre made use of the words \"Dai Lau\" in the course of being cross-examined.\n\nPage 404\n\n11.\n\n12.\n\n16.",

        "content_text": "## Government House, Hongkong, 16th December, 1903\n\nSir,\n\nI have the honour to transmit for your consideration the enclosed copy of the Gratuity Paper of Police Sergeant Angus McSwayed, who has had to be invalided from the Service owing to disablement.\n\n2.\n\nI enclose copy of his statement relating to the manner in which he received the injuries which have led to his compulsory retirement, together with a copy of the Medical Certificate and a statement by the Superintendent of the Government Civil Hospital on the subject. The enclosed draft Pension Paper shows the amount of pension to which he would have been entitled had he actually received the injuries while on duty, but as this was not so, and as Sergeant McSwayed has had less than 10 years' service, it was impossible under the regulations to grant him a pension. I have been advised by the Executive Council to submit his case to you for special consideration; not only on account of the generally good character which he has borne during the nine years he has served in the Force but also in view of the fact that he was actually returning from attendance at a fire.\n\n**THE RIGHT HONOURABLE  \nALFRED LYTTELTON, M.P.**",

        "content_text": "## Enclosure 2\n\nGovernment Civil Hospital,  \nHongkong, 30th November, 1908.\n\nThe Honourable  \nThe Acting Captain Superintendent of  \nPolice.\n\nSir,\n\nRe accident to my left foot on duty, I have the honour to report that at 12.30 A.M. on 7th September an alarm of fire was received from Government Civil Hospital. I turned out with the men and gear, but found the call was a false one. I returned in a Jinricksha; in front of No. 5 Station the Coolie stumbled. I jumped out and landed on the forepart of my left foot. I felt a severe pain there at once but could walk. Chief Inspector Baker and Sergeant Perkins were quite near me. I told Sergeant Perkins I had hurt my foot. I used the usual remedies for a strain but the pain got worse; on the 10th I went to Government Civil Hospital. Dr. Bell examined the foot and gave me a note stating I had strained the tendons, and prescribed treatment. I got leave from Ag. Dep. Supt. of Police. The foot got worse and I went to Hospital on the 15th September where I underwent an operation on the 25th October losing 4 toes.\n\nI have etc.,\n\n(Sd.) Nathan or Sir F. Lugard to the Station; and whether there was any record of permission having been granted by the Captain Superintendent of Police to Sergeant Angus, the first Police Officer to occupy the matshed, to erect it, Mr. Badeley wrote that there was no record of a visit by Sir L. Nathan but that Sir F. Lugard had visited the Station on the 2nd June, 1911; that there was an official record in the Police Daily Report of occurrences which is sent daily to the Colonial Secretary of the blowing down of the matshed on 29th July, 1908; and that \"permission was obtained from the Director of Public Works.\" \"I remember passing that paper to Police Sergeant Angus. I asked \"P. S. The history of this matshed appears to be as follows:-\n\nIn October, 1903, Sergeant Angus, a married man (with, at that time, one child but two later) was put in charge of the Police at Cheung Chau. During the winter of 1903-4, the summer of 1904 and the winter 1904-5 he and his family occupied the ordinary quarters in the Police Station. About May, 1905, (he says) he, having found during the previous summer that the conditions in the quarters were very unpleasant, sent in an application upon a form (copy attached marked 'B') to the Captain Superintendent of Police asking for permission to erect, at his own expense, a matshed on Crown Land, without fee, for his wife and family to live in during the hot summer months.\n\nHe received back this paper and in it his application was granted. He is not able to recollect exactly what was on the form through whose hands the form had passed but he thinks that it had been sent by the Captain Superintendent of Police to the Director of Public Works by whom it had been forwarded to the Colonial Secretary's Office: there were, he thinks, very terse minutes written on the form and initials, none of which he knew except those of the Captain Superintendent of Police.\n\n轉\n\nHe kept this paper for a long time and believes he handed it on to his successor Inspector Gordon by whom he was relieved in December, 1907.\n\nInspector Gordon, also married, with two children, also rather vaguely recollected this paper: but it has disappeared now. Gordon says that he understood Sergeant Angus had a permit to utilize this matshed and he further says that he both thought that this permit held by Angus would extend to his own family and that he told the Assistant District Officer, Mr. Tratman that he proposed to re-erect the shed (which seems to have been annually more or less damaged or blown down by the gales) so that it could be occupied by his wife and family during the summer heat, a suggestion which Mr. ...",

        "content_text": "261\n\nTratman (according to Gordon) characterized as a good idea. Mr. Tratman is now on leave.\n\n(B). On the other hand, there is no record to be found in any Government papers (so far as your Committee can ascertain) of any such permit having been granted. There is a record in the Police Report of 29th July, 1908, that a matshed belonging to Sergeant Gordon on the hill behind the village was blown away; but this would not convey to anyone any clear information that the Sergeant lived in it away from the Station.\n\nBut your Committee does not think it is at all unlikely that no record was kept of this very informal and petty affair: no fee was paid and the transaction would require no booking; no permanent structure was to be erected and no definite encroachment apprehended.\n\n(C). But what your Committee does wish to draw attention to is that both these officers explicitly say that they asked for permission for their wives and families, not for themselves. It is true that they both also say that they understood that they themselves (as Officers of the Police) were included in the permit: Sergeant Angus says:\n\n\"I sent in an application....for permission to erect a matshed for my wife and family to live in during the summer months. I slept in the matshed through three summers....I took it that I had permission to do so.\"\n\nInspector Gordon says \"I knew that Sergeant Angus had permission....I told Mr. Tratman that I was going to repair the matshed and put my wife and family there in the hot weather....I took it that the permission extended to me. I did not ask for special permission for myself to be absent from the quarters in the station\".\n\n(D).",

The difference between the mere occupation of the Lat shed by the family of the officer in charge and the abandonment of the quarters at the station by the officer himself is obvious. The only comment which your Committee wishes to make here is that this personal action of the Sergeants was admittedly known to and acquiesced in by the Captain Superintendent, though there is nothing to show that such was ever properly brought to the notice of the Government.\n\n6. With regard to the alleged acquiescence in the arrangements by the late Governor Sir F. Lugard.\n\n6. (A). There is no doubt that Sir F. Lugard visited the island and, according to Inspector Cordon, he showed Sir F. Lugard over the place and told him where he and his family and the Constables lived. We see no reason to doubt this account nor that Sir F. Lugard made no comment deprecatory of the arrangements.\n\n(B). Your Committee has, however, already expressed its view on this aspect of the question in paragraph 11 of its previous report.\n\nThe only other point of any importance which transpired at this further enquiry was that it would appear that up to 1904, three Indian (unmarried) constables lived in the Station and the Indian Sergeant (married) in a house next door; that it is impossible, for social reasons of Moslem feminine propriety, for married Indian women to live together with their husbands in these confined quarters; that in 1905 all four Indian Police (all married) lived outside; that they gradually drifted into living further and further away from the station; that the Chinese detective, at the time of the raid, also lived out.\n\nYour Committee has come to the following conclusions:-\n\n(a). That, whilst it is quite ready to accept the evidence of Sergeant Angus and Inspector Cordon on the subject of this written permit, the account given does not in any way show the acquiescence by Government in the occupation",

We lived in the quarters in the Station during the summer of 1904. About May, 1905, I think I sent in an application on Form P. 50 (attached) for permission to erect a matshed for my wife and family to live in during the summer months. I received back the form later with the permission to erect a matshed and to pay no fee. The minutes on the form were quite short. I think the C.S.P. sent it to the P.W.D. with the words *to you* and the P.W.D. sent it to the C.S.O. with the words \"any objection\". There were initials on the form, which I did not know. I think I handed the paper over to Sergeant Gordon when he took over from me in December, 1907. I did not lose the form. Three of the Indian Police were living in the Station in 1904 and one outside. During the summer of 1905 they were all outside the Station, but the Indian Sergeant lived in a house next door to the Station. None of the Police lived more than fifty yards from the Station while I was there. No matshed was put up for them while I was there. Married Indians cannot live in the Station because of their wives. Single men complained of fleas and mosquitoes. The Samshu factory close to the Station was very obnoxious.\n\nBy Mr. Severn. I did not hand over the matshed to Inspector Gordon as it had been practically destroyed by typhoons, but I showed him the permission I had got to erect it. I slept in the matshed through three summers 1905, 1906 and 1907. I took it that I had permission to do so.\n\nInspector Alexander Gordon.\n\nI took over at Cheung Chau from Sergeant Angus on the 26th December, 1907. There were three Indian Constables and an Indian Sergeant. The Sergeant was living in the upper floor of the building now occupied as a school on the opposite side of the street at the back of the Station. One I.P.C. was living with him.
