        "content_text": "C.O. 1526\n\nMinute by the Harbour Master.\n\n16 JAN 05\n\n498\n\nHon. Colonial Secretary,\n\nThe Master of the Vessel interviewed me on the 18th instant respecting his crew. He wished to discharge them here and take on a Chinese crew. The balance of wages due to each man was insufficient to justify my so doing. Mr. Sonnar representing the Ship's Agents here quite realised that I could take no other view, and agreed in my presence with the Master that it would be better to send the men home as passengers at a cheap rate.\n\nThis is only hearsay. I have since learned that an arrangement has been come to with a German Firm to land the men at Genoa for a sum at $17 per head (the men are mostly Italians).\n\nWith regard to the telegram, if such a guarantee is given that is all that is required, such an arrangement was not mentioned to me.\n\nThe owners of the \"Inkula\" are the same that own the \"Inkur\" so that I shall require if a guarantee is given that it is genuine.\n\n15th December, 1904.\n\n(Sd.) Therefore the Italian crew were engaged \"to go from Italy for the run out only\". Therefore there was or should have been no misunderstanding between the contractor, the men, and the Hong Kong Government were only concerned to see that due provision was made under the Act for the subsistence and maintenance of the seamen to the satisfaction of the Harbour Master. According to the Harbour Master's minute of 15th December, which formed an enclosure to the Governor's despatch of 16th December, the master of the vessel interviewed the Harbour Master on the 13th December and wished to discharge the crew and take on a Chinese crew. The Harbour Master did not consider that the balance of wages to the men was sufficient to justify that course, and it appears that the ship's agent realised that he, the Harbour Master, could take no other view and agreed that it would be better to send home the men as passengers at a cheap rate. A similar account is given in the Harbour Master's minute of 22nd December, enclosed in the Governor's despatch of 27th December, with the addition that the master of the ship is said to have stated that under the terms of the agreement he had the option either to send the men home or to give them a month's wages in lieu;\n\nthe Harbour Master says he informed the Master that he was prepared to agree to the second alternative if the men agreed to it, provided that the money, or such part of it as he deemed sufficient, was handed to him as a guarantee for the men's maintenance while they remained in Hong Kong. This is stated by him to be the usual procedure in Hong Kong when men are paid off, but the present crew would not agree to it, and the Harbour Master therefore advised, and the master and the agent agreed, that the other alternative should be adopted and the men sent home as passengers at cheap rates. Arrangements were made with a German firm to take them to Genoa, apparently (as appears from the earlier minute) at £17 a head, but the owners refused to take this course.\n\nThe owners' account, written on the 13th December, was that the Hong Kong authorities informed the captain that the men must be returned to Italy and that they had instructed the captain to take no responsibility in the matter, and to refer the British authorities to the Italian representative. On the 14th, the owners came to this office and a telegram was sent to Hong Kong asking whether the law would not be complied with if the men were discharged in accordance with agreement, the owners guaranteeing the cost of repatriation if the men became distressed seamen. This should be verified; but was it reasonable to insist that the owners Italians should reship these men as passengers at £17 a head or whatever the actual sum was when by a definite agreement they could pay over to the men a sum of money smaller in amount but which would clearly not leave them destitute for some time.\n\nIn what respects did the men allege that they had been misled as regards their agreement? On what grounds does the harbour master in his earlier minute suggest that the owners' guarantee might not be genuine and in his later minute that their action, which consisted in discharging men in accordance with a contract with a certain sum of money in their possession and a promise to pay the cost of repatriation if they became distressed sailors, was 'unscrupulous'.\n\n7. What is the exact law and practice in the United Kingdom? There must be numbers of cases where foreign crews are discharged in British ports.         "content_text": "## 767(2)\n\nAt what date after their discharge did they become a charge upon the Colony? i.e., how long did the money in their possession last and how long might it have been reasonably expected to last?\n\nThe 28 men were discharged on the 23rd December. Two of them that were Germans joined a Man-of-War of that nationality that happened to be in the Harbour, and 12, mostly Italians, went to Singapore. I have no record of what became of them there. Of the remaining 14, 5 were sent to Europe on the S.S. \"Ben Lomond\" on the 5th, 4, including two who had become destitute on the 9th, by the S.S. \"Kintuck\" on the 11th, and 4, including one who had become destitute on the 9th, by the S.S. \"Hyson\" on the 22nd January - a month after discharge from the \"Inkula\".\n\nWhen discharged the men had sums varying from $173.37 in the case of Oreste Turbiglio, the Chief Steward, to $59.52 in the case of Fredrick Brandt, the Engineer's boy. Such sums, which should keep men for a considerable time in ordinary circumstances, do not last long in the hands of a paid-off crew in a port full of temptations. It is sometimes as much as 2 months before an opportunity offers of sending sailors to Europe as distressed British seamen, and it was fortunate in this case that the whole of the crew was disposed of within the month. To this the men declined to agree, and they were within their rights in insisting on full payments being made to them personally as a condition to accepting their discharge before it became due under their agreements. The difficulty was got over by my assenting, as reported to you in my telegram of the 15th December, to the crew being discharged on the owners' guarantee of the cost of the men's repatriation if they became distressed seamen. Is it the case, as Captain Barnes-Lawrence states that crews paid off in Hongkong are in the habit of allowing part of their pay to be deposited with the Harbour Master as a guarantee for their maintenance while remaining in the Colony and that the refusal to adopt this course in the present case was unusual?\n\nThe due provision for the subsistence and maintenance of which the Harbour Master has to be satisfied under sub-section 5 (a), section 7 of \"The Merchant Shipping Ordinance, 1899\" before allowing discharge in the port is, as stated in the 2nd paragraph of my Despatch of the 27th December, usually taken to be the deposit of $60 for the subsistence and maintenance of each man in the Sailors' Home it having been found by experience that a deposit of this amount is nearly always sufficient to provide for a seaman until an opportunity occurs to send him to Europe.\n\nCrews paid off in Hongkong are therefore, except in special circumstances, given no option in the matter of a part of their pay being deposited with the Harbour Master as a guarantee for their maintenance while remaining in the Colony and the permission given for the discharge about 4 months ago is still valid.\n\nPage 770 \nPage 141",

These regulations and conditions are essential for keeping the number of destitute Europeans in the Colony within manageable limits.\n\n(5) \n\nIn what respects did the men allege that they had been misled with regard to their agreements? On what grounds did Captain Barnes-Lawrence, in his minute of 15th December, suggest that the owners' guarantee might not be genuine, and in his minute of 24th December express the opinion that the action of the owners in discharging the men in accordance with an agreement, with money in their possession and with a promise of repatriation if they become destitute, was \"unscrupulous\"?\n\nThe men were unanimous in saying before the Harbour Master and the Italian Consul-General that they had been informed that they were to receive at the port of discharge one month's pay in addition to their passage to England. I have still grave doubts as to whether enterprise of this nature is really deserving of your special support. I am also still of opinion that the proper course for these owners to have pursued was to have sent the men home when they no longer required their services in the manner I understand to have been originally contemplated by their Agents, that is by obtaining cheap passages for them by arrangement with some other line. This is what was done in the case of the \"Ikbul\", also belonging to Messrs. Welsford and Company, which arrived here on May 19th, 1904, from Singapore in ballast and left for Taku on the 2nd June to be employed in the coolie trade.
