        "content_text": "## MINUTE\n\nOf Colonial Admiral Agent \n\nThe question arises regarding the Extradition of a person accused of murder who has fled to Hongkong. In this situation, we see no objection to his being surrendered if he has committed a murder within French jurisdiction (see Extradition Treaty of Feb 18, 1843, 6 _Hertslet_: p. 345) and if the evidence is sufficient at a preliminary hearing, as agreed by Treaty and sanctioned by Act of Parliament (6 and 7 Vict. c. 75, 16 _Hertslet_: p. 448). As to the question which we understand to be asked with respect to the correctness of the opinion of our predecessors of July 21, 1852, we have today decided that if that opinion is taken to refer to the jurisdiction of the Colonial Court to try the offence of murder, we think it correct, but that if the offence was one of Piracy (a view of the law which does not appear to have been considered), we think it open to question.\n\n(signed) J.S.         "content_text": "MINUTE.\n\nHongkong, 2003 (should be 1873)\n\nIndexed\n\nAnswered F.O. 3380/72\n\n119\n\nSowany Theat 8 March 1873\n\nWith reference to your letter of the 16th (presumably \"ultimo\" or a date is missing),\n\nWith respect to the decoying Chinese from this Colony to Macao, or the decoying them from the mainland of China into the Colony with a view to their transmission to Macao for the purposes of Emigration, these offences have already been provided for by a Bill now before the Legislative Council, of which a copy has, I believe, been transmitted to the Secretary of State.\n\nIt is unnecessary to say that no British ship can clear out with Chinese Emigrants from Macao; for the British Emigration Officer's Certificate for that purpose cannot be obtained, and without it, the ship would be liable under \"The Chinese Passengers' Act, 1855,\" to seizure and condemnation, and the Master would incur a severe penalty.\n\nThe new Bill, therefore, which I have drafted, though general in its terms, and though it makes no allusion to Macao, is practically directed against the building and equipping within the Colony of foreign ships for the purpose of Chinese Emigration from Macao, and it prohibits any participation in such Emigration. (R).\n\n67\n\nprox\n\n2.14577\n\n[Despatch No. 368] of 1935.\n\nRe-exportation of arms from Hongkong to China.\n\nUnder system authorised in despatch under reference and subsequently put into practice Waichiaopu request the Embassy to notify Hongkong Government of arrival of arms consignment inviting them to grant necessary facilities, Embassy telegraph Hongkong and receive a telegraphic reply which is duly communicated to the Waichiaopu.\n\n2. The Governor of Hongkong now suggests that as His Excellency would not normally oppose an application to export war material that had the backing of the Chinese authorities this tedious procedure might be simplified by abolishing prior reference to Hongkong except in cases of emergency which did not permit the adoption of full routine of confirmatory huche. Hongkong Government would issue permits on local application if they were satisfied that such application was fully authorised by Central authorities.\n\n3. This suggestion was conveyed to the Waichiaopu who replied that they agreed to permits being granted on local application without prior reference, provided each application was accompanied by a Central Government huche.\n\n4. Knatchbull-Hugessen to Mr. Eden.—(Received May 18.)\n\nCopy No. 71\n\nNanking, April 9, 1937.\n\nIN my despatch No. 20 of the 9th April, reporting my visit to Hankow and South China, I mentioned that the Mayor of Canton had repeatedly raised the question of closer co-operation between Great Britain and China and particularly between Hong Kong and Kwangtung.\n\nCo-operation is of course the most obvious theme on these occasions, and almost every speech and exchange of courtesies during my tour was full of polite generalisations as to the advantages of closer co-operation between our two countries. At Canton, however, it soon became clear that the mayor, who is a man of considerable vigour and energy, wished to take advantage of my visit to the South to translate these generalisations into more closely defined terms.\n\n3. I have the honour to enclose herewith a cutting from the Canton press giving a verbatim report of Mr. Tseng's speech at the dinner given by him in my honour,(1) and also a brief summary of my reply.(1) It will be seen that Mr. Tseng's references to co-operation were almost embarrassingly direct and indeed exclusive. It was not the co-operation of \"friendly Powers\" or \"assistance from abroad\"—the conventional phrases—that was sought; it was the assistance of our country which was needed and our economic co-operation which was earnestly desired. The speech was delivered with a good deal of emphasis and was warmly applauded. I had not the least doubt that both the speaker and his audience had in the back of their minds, and wanted me to understand, that the co-operation must be exclusive as it was directed against a common adversary. In my reply I was accordingly careful to address myself particularly to this implication in the mayor's speech. While applauding and associating myself with his remarks on the subject of co-operation, I emphasised that such co-operation must be exclusively economic in character, and could not be such as would damage, or be to the disadvantage of any other country. As on many previous occasions, I pointed out that co-operation, as understood by me, would on the contrary be to the advantage of all countries, since all countries stood to benefit by each other's prosperity.\n\n4. In his speech the mayor referred specifically to the scheme for the development of Whampoa port. In previous conversations on this subject I had expressed the purely personal opinion that Hong Kong, Whampoa and Canton should be regarded as three complementary parts of one unit and that prior consultation between Hong Kong and Kwangtung might serve to decide the respective parts which each of the three might most usefully play in the interest of the whole. I had been, however, careful to qualify my remarks with a warning that my suggestion was purely personal and that I was still in ignorance of the views of Hong Kong on this matter. The next day the mayor called on me and said he was much struck by some of my observations. The Chinese Government was about to embark on gigantic schemes of industrial development which could most appropriately be executed by the co-operation of British capital and Chinese labour if only the Hong Kong and Shanghai Bank and British financial houses were not so conservative and unwilling to take the slight risk—which was really no risk at all in the changed conditions of modern China—of lending money on easier terms.\n\n5. This interview, which lasted nearly two hours, was brought to an end by my leaving for a luncheon engagement, and it later appeared as I had suspected that the mayor, carried along by his own loquacity, had never reached the main point of his visit.         "content_text": "## 2 \n\nThe Chinese Minister for Foreign Affairs. Owing to a recrudescence of internal political troubles, the negotiations were then suspended. In the autumn of 1931, the Japanese launched their attack on Manchuria, and the whole question of extra-territoriality has remained in abeyance ever since.\n\n4. Since 1931, in spite of their external difficulties, the Chinese have made great progress in political and constitutional matters. Their Central Government is now a reasonably efficient administrative machine, and its authority is generally recognised over the greater part of China. Even the long-standing division between North and South has recently been healed. There has also been great progress in the codifying of the laws and in judicial administration generally. Finally, Japan, whose aggression was a considerable factor in unifying China, seems to have abandoned coercion for conciliation and may now be found willing to deal with China on a footing of friendliness and equality.\n\n5. At the recent plenary session of the Kuomintang, a resolution was passed in favour of taking up the extra-territoriality negotiations once more. No action has as yet been taken by the Chinese Government on this resolution, but the subject is being ventilated in the press in China, and Sir H. Knatchbull-Hugessen has had some conversations with the Minister for Foreign Affairs. He is strongly of the opinion that we should be sympathetic to any approach made to us by the Chinese Government. Copies of the three telegrams Nos. 106, 114, and 116, which we have received from Sir H. Knatchbull-Hugessen, are annexed hereto (`Annexes III`, `IV`, and `V`). In their Aide-Mémoire of the 30th March last (`Annex I`), the United States Government expressed the view that negotiations on the subject of extra-territoriality might be taken up, and enquired whether, in our opinion, it would be better for the foreign Governments to take the initiative in approaching the Chinese Government, or whether it would be better to await proposals from the Chinese Government. An interim reply was sent to the United States Embassy on the 14th May (`Annex II`), favouring the latter course and promising a further communication as soon as a decision had been reached on the important points of policy involved.\n\n6. It has been the consistent policy of successive British Governments to assist China in every way possible in the political and economic development of their country; and if any request is now made to negotiate on the subject of extra-territoriality, it would not be either wise or indeed possible to depart from the friendly and sympathetic attitude that was adopted in the previous negotiations, or to withdraw substantially from the policy of the 1931 draft. In view of the greater degree of unity and stability that China has achieved since 1931, it is probable that, as stated in the United States Aide-Mémoire, the Chinese will now insist upon an agreement of a more far-reaching character. It would seem best, however, to begin negotiations on the basis of that draft and defer consideration of details until after negotiations have actually begun.\n\n7. The draft treaty of 1931, of which a copy is annexed hereto, `Annex VI`, contained a number of safeguards designed to protect the persons, property, and vessels of British subjects, on coming under Chinese jurisdiction, against the arbitrary exercise of power or uncertainty as to the law to be applied.\n\n8. The principal safeguards were that British subjects were to be subject only to the modern Courts of Justice and to the duly promulgated laws, ordinances, and regulations of China; cases involving British subjects as defendant or accused were only to be tried in the modern courts at certain selected centres, and foreign legal counsellors with watching and advisory functions were to be attached to these centres. Provided the safeguards of the 1931 draft could have been exercised without offending Chinese amour-propre, it seems probable that the arrangements of the draft treaty would have proved a satisfactory substitute for the present system. China has, indeed, now reached the stage when, as in other countries, diplomatic representations would probably be the best protection for British subjects against even the unfettered exercise of Chinese jurisdiction, but as public opinion is not ready for such a root and branch solution, it would seem best, when negotiations begin, to endeavour to secure the consent of the Chinese Government to as many of the safeguards of the 1931 draft as possible.\n\n9. The greatest difficulty arises out of the peculiar position of the International Settlement at Shanghai, the foreign administration of which depends very largely upon the continued enjoyment of extra-territorial privileges by the Powers chiefly concerned. In the 1931 draft, the whole area of Greater Shanghai, namely, the International Settlement and the neighbouring areas, which are largely inhabited by foreigners, was excluded from the operation of the treaty. Foreign control of the International Settlement, in face of the Chinese determination to undermine it, is becoming more precarious, and British predominance in the municipal administration of Shanghai tends to involve us in disputes between Chinese and Japanese which are not really our concern. It is by no means certain, therefore, that the exclusion of Chinese authority from the Settlement should continue to be an object of British policy. In view, however, of the complexity of the problem of Shanghai and the multiplicity of the national and other interests involved, it will be best to insist now, as in 1931, on complete exclusion so as to afford time for further negotiations. In the 1931 draft (article 16), Shanghai was excluded for ten years and Tientsin for five years. The United States Government, while willing to throw in Tientsin altogether, considered that the time limit for Shanghai was a mistake. It may be difficult to secure the assent of the Chinese to the indefinite exclusion of the whole area of Greater Shanghai. On the other hand, it is obviously unsatisfactory that negotiations should be carried on under pressure of a time limit, and we might, therefore, accept the American view on that point.\n\n10. If the Cabinet approve of the adoption of a policy on the lines recommended above, a further question arises in relation to Japan. It would seem to be desirable, in view of the present conciliatory attitude of Japan, to propose to them to adopt the same attitude as ourselves and the United States over the question of extra-territoriality. His Majesty's Ambassadors at Peking and Tokyo are being consulted by telegram on this point and also on the subsidiary points as to time and method, namely, whether it would be better to approach Japan now or wait until actual proposals on the subject of extra-territoriality are made by China, and whether the approach should be made in Tokyo jointly with the Americans or separately in London and Washington.\n\nMay 25, 1937.\n\n**(Strictly Confidential.)**\n\n## ANNEX 1\n\n## Aide-mémoire\n\nA. E.\n\nThe Department of State has for some time been giving thought to the question of the possible practicability of there being made by the American Government an approach to the Chinese Government suggesting resumption of the extra-territorial negotiations which were interrupted in 1931 and have since been in abeyance. It has been the view of the Department of State that the practicability of making such an approach should be considered in terms of the possibility of the approach being made simultaneously and on parallel lines by the American and the British Governments. It has been felt that the question of the opportuneness of such action at this time largely depends upon the question whether the resumption of such negotiations would be likely to have a disturbing effect upon the general situation in the Far East with special reference to Sino-Japanese relations and the question of the likelihood of the Chinese Government being willing to accept a draft of a treaty following substantially the lines of the American draft of the 14th July, 1931. (The American draft is similar to the British draft of the 6th June, 1931, except for article 16: Reserve Areas, a copy of which article, together with a copy of the Department's memorandum, was enclosed in Mr. Atherton's letter of the 25th July, 1931, to Mr. Orde.)\n\n2. The United States Embassy in China has reported that during the recent plenary session of the Central Executive Committee, there was adopted a resolution calling upon the Chinese Government to conduct negotiations for the abolition of extra-territorial jurisdiction. This resolution, quoted in an instruction to the Executive Yuan on the 6th March, was published in the National Government Gazette of the 9th March, but otherwise it has received little publicity. The United States Embassy has received no intimation as to what action the Chinese Government will take in the matter.\n\n`[15299]`",

In the course of a private conversation with the Minister for Foreign Affairs at tea with me yesterday evening, I mentioned that I had been somewhat puzzled by suggestions in the press that the question of extra-territoriality might be raised at this juncture. Our attitude was already sufficiently clear. It was an intricate question with which I was not familiar, but I would, of course, study it. I had, however, not been disposed to place too much faith in these press reports as I should have thought the Chinese Government had enough on their hands at present without raising extra-territoriality, which must inevitably produce friction with some Powers.\n\n2. The Committee considered the following general principles in relation to the administration of the Fund:\n\n(1) The statement contained in the appeal, as published on October 2, i.e., \"The money and material sent to China will be administered by an organisation to be constituted in that country under the Presidency of H.M. Ambassador, Sir Hughe Knatchbull-Hugessen and the Vice-Presidency of the Governor of Hongkong, Sir Geoffry Northcote\".\n\n(2) Extract from a letter from Mr. Lionel Curtis to the Secretary of the China Association dated September 30, 1937: \"I think it is a cardinal mistake to send money to China except for the relief of our own fellow countrymen in distress. So far as the Chinese civilians are concerned who have been mutilated by Japanese bombs and shells, what is needed is a rushing out to China of surgeons and medical equipment through the agency of the Red Cross. At present, neither surgeons nor medical equipment can be got for money in China\".\n\n(3) The relative position which the relief of British sufferers, as distinct from Chinese sufferers, is to hold in the scheme of relief.\n\nPage 50\nPage 51",

        "content_text": "## THE FUND FOR THE RELIEF OF DISTRESS IN CHINA.\n66\n\nSir,\n\nWe write to ask you to allow us through your columns to announce that in conjunction with the Committee of the China Association, the British Red Cross Society, and the Conference of British Missionary Societies, we have decided to open a fund for relief of distress in China. The money and material sent to China will be administered by an organisation to be constituted in that country under the Presidency of H.M. Ambassador, Sir Hughe Knatchbull-Hugessen and the Vice-Presidency of the Governor of Hongkong, Sir Geoffry Northcote.\n\nWe have been moved to take this decision, and we base our appeal for contributions, upon the broad, human ground that the conflict is occasioning terrible suffering in all its forms amongst untold numbers of Chinese. The total of those rendered destitute is immense. Reliable figures cabled to the China Association from Shanghai show that 100,000 completely destitute refugees are being maintained in camps in the Shanghai area alone, while help is also being given in various forms to another 100,000 in that district. Some 250,000 have been moved away from Shanghai by boat and train, but they are being rapidly replaced, the estimated total of destitute Chinese for whom Shanghai will have to provide in the near future being 500,000. Tientsin, Peiping, Hankow, Canton, and many other centres are faced by similar problems. British national societies and firms are doing their utmost to help, but their resources, already crippled by the disorganisation of trade, are quite inadequate. There is a desperate shortage at all centres of essential hospital equipment, including anaesthetics and antiseptics, the lack of which is resulting in suffering too hideous to describe. The resources of British hospitals are breaking down under the strain of emergency service, while there are also British subjects in urgent need of help.\n\nThe care of sick and wounded members of the fighting forces will be the special interest of the British Red Cross Society, which is already acting in co-operation with the Chinese Red Cross Society.\n\nContributions may be sent to the Hon. Treasurers, Mr. D.G.M. Bernard, Hon. Treasurer of the China Association, 161, Shell-Mex House, Strand, W.C.2, or Mr. F.P. Harris, Treasurer of the Conference of British Missionary Societies, Edinburgh House, 2, Eaton Gate, S.W.1. Contributions for the British Red Cross Society may be specially earmarked and sent to the Hon. Sir Arthur Stanley, British Red Cross Society, 14, Grosvenor Crescent, London, S.W.1. All cheques should be crossed \"& Co\": funds will be remitted to China through the `Hongkong and Shanghai Bank Ltd`.",

Dullion, the British Vice Consul, who, as head both of the local Electric Light Company and of the local Waterworks, is concurrently the principal business man in the Colony. As it had come to my unofficial knowledge that His Excellency Dr. Tamagnini Barbosa, the present Governor of Macao, was inclined to think that the alleged services to Hong Kong and British interests on the part of his Colony (such as discouragement of Japanese developments, and grants of requests made by the Hong Kong authorities) received insufficient recognition, and that he would welcome a visit primarily from His Excellency the Officer Administering the Government of Hong Kong, but also from myself, as a friendly gesture, I considered that some useful purpose would be served by paying an official call on His Excellency. It was consequently arranged that I should visit Macao in H.M.S. \"Moth\" which was kindly placed at my disposal by the Senior Naval Officer, at river. Accordingly I left Canton at 8.00 a.m. on August 2nd, stayed two nights at Macao \n\nSir Hughe Knatchbull-Hugessen, K.C.M.G., \nHis Majesty's Ambassador, \nBritish Embassy, \nNANKING.",
