Staveley, Lt Col. Mordy, and Mr. Home on the Militia Requirements of Land in the Kowloon Peninsula; the second forwarding a letter from Col. Invine commenting on Mr. Home's remarks, with a plan of the ground.\n\nIt appears that the original text was heavily distorted due to OCR errors. I have made the following corrections:\n1. Reordered and rejoined broken sentences.\n2. Removed extra characters and gibberish (`Minne dink`, `4991`, `}`, `(R`, etc.).\n3.         "content_text": "# GovI. 378\n## 18. 7. 30.\n### 2\n\nRequests directions as to procedure in the case of persons against whom a verdict of Guilty but Insane has been found.\n\nOn 74165, the Assistant High Commissioner for the Western Pacific asked for instructions in two cases in which persons accused of murder had been ordered to be detained during His Majesty's pleasure, and we were not clear what instructions he wanted.\n\nIt is a fortunate coincidence that at the same time we should receive a despatch from Hong Kong, asking similarly for instructions, but setting out clearly exactly what the difficulties are.\n\nThere appear to be two questions to be answered:\n1. How persons ordered to be detained during His Majesty's pleasure are to be treated, and\n2. Who is responsible for arriving at the actual decision as to their treatment.\n\nAs regards (1), the Governor of Hong Kong's difficulty is as to whether he must simply detain such persons as lunatics, or whether he may impose imprisonment with hard labour. The latter appears to have been the practice in the past, but Sir William Peel has taken the view that he has no power to impose hard labour. I am not sure whether this view is correct, as section 76(2) of the **Criminal Procedure Ordinance** states that the Governor \"shall order such person to be dealt with as a lunatic under the laws for the care and custody of lunatics or otherwise as he may think proper\". It is desirable to ask for the advice of the Home Office, as Mr. Ellis has already suggested should be done in the Solomon Islands case. The Hong Kong Ordinance is modelled on a United Kingdom Act and the question must have been settled in this country.\n\nAs regards the second part, the Order of the Court is in the form that the person shall be detained during His Majesty's pleasure and Sir William Peel asks whether in cases where it is desirable to release the prisoner he is empowered to make known His Majesty's pleasure, or whether he must refer such cases to His Majesty through the Secretary of State. It is clearly undesirable that such cases should be referred here. The matter is really one of pardon which power lies within the discretion of the Governor, but it is not clear whether, as a matter of form, Article 15 of the Hong Kong Letters Patent authorises the Governor to act in such a matter.\n\nI cannot discover any other provision of the Letters Patent or Royal Instructions bearing on the matter. The Trial of Lunatics Act, 1883 is referred to in the despatch. Section 3 of this provided that in the case of Ireland, the Lord Lieutenant should be authorised to act by the substitution of the words \"The pleasure of the Lord Lieutenant\" for \"Her Majesty's pleasure\". OFFICE**\n\nMy Lord,\n\nI have the honour to request that I may have Your Lordship's directions in the matter of the procedure that should be adopted in the case of persons concerning whom a special verdict of guilty but insane at the time concerned has been found by a jury.\n\n2. I attach for ease of reference a copy of the relevant sections of the Criminal Procedure Ordinance of 1899 which are based upon section 2 of 46 and 47 Vict. c.38.\n\n3. It would appear that detention in such cases may be ordered either in the Lunatic Asylum or, if it should be more convenient, at the Victoria Gaol; but in the latter case it would in my opinion be irregular that imprisonment with hard labour should be imposed in place of such simple detention.\n\n4. I shall be glad of definite instructions on this point as there is at present in Victoria Gaol a prisoner who was in 1917 ordered to be detained there under section 76 of the Ordinance quoted above, the order in question bearing the Governor's endorsement \"to be imprisoned with hard labour for life\".\n\n## THE RIGHT HONOURABLE LORD PASSFIELD, &c., &c., &c.\n\n5. There is another similar case where a prisoner was in October 1929 ordered detention on the same terms and who is now certified as being fit to leave the Asylum.\n\n6. In both of these cases I am issuing instructions that hard labour should not be imposed, as it appears to me that no power lies with the Governor so to alter the order of the Court under the section quoted.\n\n7. There is the further question of the authority necessary for the ultimate release of such persons, on recovering their sanity, from the detention imposed in accordance with section 76 of the Ordinance.\n\n8. Article XV of the Letters Patent give such wide powers to the Governor in the matter of the grant of pardon that I would have no doubt that these include the cases now under review were it not for the specific mention of His Majesty in the order of the Court.\n\n9. I shall be glad therefore of Your Lordship's instructions as to whether I am to exercise in such cases the powers granted under Article XV of the Letters Patent, or whether each case is to be referred to you for an expression of His Majesty's pleasure in the matter.\n\n10. An alternative suggestion has been made that the word \"Governor\" might be substituted for \"His Majesty\" by an amendment of the section quoted, on the analogy of section 3 of the Trial of Lunatics Act of 1883.\n\nI have the honour to be,  \nMy Lord,  \nYour Lordship's most obedient,  \nhumble servant,  \nLive  \nGovernor, &c.\n\nPage 10  \nPage 10  \nPage 11",

        "content_text": "# CRIMINAL PROCEDURE ORDINANCE, NO. 9 OF 1899.\n\n11\n\n## Arraignment and trial of insane person.\n\n74.-(1) If an accused person appears, either before or on arraignment, to be insane, the court may order a jury to be empanelled to try the sanity of such person, and the jury shall thereupon, after hearing evidence for that purpose, find whether such person is or is not insane and unfit to take his trial.\n\n(2) If, during the trial of an accused person, such person appears, after the hearing of evidence to that effect or otherwise, to the jury charged with the indictment to be insane, the court shall in such case direct the jury to abstain from finding a verdict upon the indictment and, in lieu thereof, to return a verdict that such person is insane: Provided that a verdict under this section shall not affect the trial of any person so found to be insane for the offence for which he was indicted in case he subsequently becomes of sound mind.\n\n75. Where in an indictment any act or omission is charged against any person as an offence, and it is given in evidence on the trial of such person for that offence that he was insane, so as not to be responsible, according to law, for his actions at the time when the act was done or the omission made, then, if it appears to the jury before whom such person is tried that he did the act or made the omission charged, but was insane as aforesaid at the time when he did or made the same, the jury shall return a special verdict to the effect that the accused person was guilty of the act or omission charged against him, but was insane as aforesaid at the time when he did or made the same.\n\n76.-(1) When any person is found to be insane under the",
