The delay is, however, I think, immaterial, as the letter from the Colonial Secretary to the Consul for France in charge of the Spanish Consulate at Hong Kong of the 2nd of May last made it clear that \"no early answer except an unfavourable one could be given to the Spanish Government's proposal.\n\nI agree generally with Mr. Caine's views. Personally, I am not aware whether we have at some previous date considered the general question of principle whether emigration from British Colonies should be allowed to Spanish possessions, but it seems to me that if we are at all doubtful on this point, we ought to consult the Foreign Office with a view to ascertaining whether they have in their possession any information about the conditions of labour in Spanish Guinea. No doubt British Consular Officers in West Africa send home reports from time to time on local conditions in neighbouring foreign dependencies, and it is quite likely that the Foreign Office may have some data which will throw light on the shortage of labour in the Spanish territories, and as to whether the local Government has been able to recruit Chinese labour in the past.\n\nI am told by the Registry that there are no papers regarding reports on conditions in Rio Muni (Spanish Guinea). The only papers on labour in Spanish possessions which we have are relating to Fernando Po (C&O 4020/28 and previous papers) [Action is required in the 19 C&O 4020, attached].\n\nPage 9\n\nI do not like the idea of recruiting in Hongkong coolie labour for West Africa. Further, though much seems to be forthcoming about conditions in Fernando Po, it is relevant that \"the principal conditions of labour are good, but actual conditions can vary from bad to good.\" I also observe that Rio Muni is a recruiting ground for labour.\n\nFrom the F.E. point of view it seems sufficient at present to refer to conditions in Spanish Guinea, and to ask M/L for comments regarding the proposal.\n\nIf it rested with me, I would refuse to allow any emigration to Spanish Guinea. Conditions are not at all likely to be satisfactory in practice. Health is bad: sleeping sickness is rife in Fernando Po. I am fairly sure that it is in Fernando Po that the labour is needed, as our papers show. There is a risk of introducing yellow fever into the land with returning coolies, as we don't know enough about it.\n\nIn referring to F.O. W.Africa, we might call attention to our cone (4020/18). Also, I do not like the idea of introducing Chinese in W.Africa. The G. Coast mines wished to do so before the war, but we had to stop it. There are many objections. MR. R. H. KOTEWALL.-I should like to declare my interest as an Honorary Director of this Company and I shall therefore abstain from voting.\n\nHON. MR. J. P. BRAGA.-Could this Committee have a little more information explaining the circumstances of this case? It is stated here that in view of the circumstances the Government has decided to re-adjust the terms, but what those circumstances are is not explained in the item.\n\nTHE COLONIAL SECRETARY.-I think we can give all the explanations we have available.\n\nHON. MR. BRAGA.—I should like to know whether the reclamation scheme for berthing ocean steamers has been abandoned or not, and if it has been abandoned whether it is on the advice of the Harbour Master or the Harbour Master and the Harbour Board. If no such advice has been taken, can the Committee be informed why it is that the scheme in its original form has been abandoned and apparently a gift of $300,000 is to be made to the Crown Lessee of Marine Lots Nos. 430 and 431.\n\nTHE COLONIAL SECRETARY.-At the time this arrangement was made there was no Harbour Board in existence. Also, the times when the arrangement was made with Mr. Kwik were spacious times and we were expecting to develop very rapidly in other parts of the Colony as well as at North Point. Mr. Kwik had arranged on his own lot to build a wall on a slope, which necessitated piers running out for the berthing of ships. After he began his work and carried it on, nearly to completion, the Government had in mind the continuation of this development on Mr. Kwik's property and further eastward and intended to make a perpendicular seawall so that ships could lie alongside, and to unify the scheme. They approached Mr. Kwik to alter his seawall to come into line. Mr. Kwik saw the advantages to him if the Government carried out the complete scheme, and he was prepared to do it under the conditions you see in this minute—the advance of a loan of $600,000—but the scheme cost him a good deal more. The circumstances of the Colony have altered and the Government are no longer in a position to carry on immediately with the continuation of this perpendicular seawall. Mr. Kwik has reaped certain advantages from having altered his design, but he has lost something by the lack of the continuation of this wall by the Government, and this new arrangement is considered to be a fair adjustment between the two parties.\n\nHON. MR. BRAGA.-But one portion of my question is left unanswered. It is true that the Harbour Board was not then consulted, but the Harbour Board has since come into existence and I take it from the Minute that the decision to abandon the original scheme must have been arrived at after the formation of the Harbour Board.\n\nTHE CHAIRMAN.-It is abandoned for the time. We cannot say any more than that. It is impossible for the Government in the present circumstances to continue.\n\nHON. MR. BRAGA.-The unanswered portion of my question is whether the opinion of the Harbour Master has been obtained for the abandonment of the scheme?\n\nTHE CHAIRMAN.-At the moment, it is purely a financial question.\n\nHON. MR. PATERSON.-The loan, I take it, is secured on the property?\n\nTHE CHAIRMAN.-Yes.\n\nHON. MR. This land was at this time known as Lots A, B, and C, and Mr. Kwik desired to acquire Lots A and B at the same price as he paid for the original Lots, namely 75 cents a foot, and Lot C (presumably because its position made it more valuable) at 1.50 a foot.\n\nThe Public Works Department suggested that he should have Lots A and B only, which gave him a front of 675 feet, or one-half the original frontage, and that only on condition that he added to his obligations in respect of a certain nullah referred to in the Sale Conditions, which was the eastern boundary of the proposed reclamation.\n\nAgainst this proposal he protested in a letter dated the 14th November, 1922, which should be referred to. The Director of Public Works' reply to this latter, dated the 24th November, 1922, ought certainly to be perused also. More particularly, the statement therein that nothing had been done which affected Mr. Kwik's development of his property.\n\nMr. Kwik's protests were, however, unavailing, and on the 5th January, 1923, he accepted the offer of the Lots A and B made by the Director of Public Works on the 2nd of that month.\n\nThis last letter stated that the Government was not prepared to consider the disposal of the area coloured blue (i.e., C) at present. This was a rather singular letter in view of the offer made by Mr. Kwik in his letter of the 23rd.\n\nOn the 2nd May 1923, Mr. Kwik sent a plan of an amended development based on the understanding that the Government was going to carry out a corresponding scheme. See particularly paragraphs 2 and 3 of this letter. But the whole of it is of importance as showing the view taken by Mr. Kwik.\n\nOn the 10th May he wrote again elaborating the scheme. Perhaps his eyes were not sufficiently open to all the risks, but the Government, who have also been disappointed in their hopes, can scarcely be asked to bear all the burden of his optimism and bad judgment. In the second place, Mr. Kwik has got in the vertical sea wall a potential asset which may conceivably become actually valuable at an earlier date than seems probable at present. In the third place Mr. Kwik obtained the \"blue\" area at a price far below its market value. This is a most important consideration and it is completely obscured in Mr. Davidson's letter and in Mr. Kwik's letters. It is obscured because of Mr. Kwik's strange and untenable theory that he had an \"inherent right\" to a frontage on the new 100-foot road. On 18.4.22 the Hong Kong Electric Co., Ltd., applied for an extension to the westward of their property, M.L.321, in order to provide additional space for storing coal against another strike. The Director of Public Works addressed the Government on this application on 7.6.22. There was an objection to an extension westward and the Director of Public Works suggested that Mr. Kwik might be willing to give up part of the west side of M.L.430 and take instead, at the price paid for M.L.430, 75 cents, the area generally known as \"A\", or that area and area \"B\". This, of course, would have involved closing part of the old Shaukiwan Road, but it would have been closed only in order to sell the land to Mr. Kwik. The Director of Public Works (Mr. Perkins) explained to Mr. Marsh (Hong Kong Electric Company) \"that the whole scheme was dependent on agreement by the owner of M.L.430 to the scheme and, of course, approval of Government\". It is his purchase of areas \"A\" and \"B\" which necessitates the closing of the old road and it was he who applied to purchase the areas in question.\n\nTwo months before he agreed to purchase them he had rejected the Hong Kong Electric Company's scheme, and if he had not voluntarily purchased them there would have been no power to close the old road except on payment by the Government to him of strict compensation for the road frontage rights which he would have thereby lost. In fact, from first to last there does not appear to have been any intention of taking away those frontage rights against his will, even on compensation.\n\n3.\n\nIn view of these facts, the first of Mr. Davidson's two main points, deprivation of road frontage, completely fails.\n\n4.\n\nMr. Kwik cannot complain merely because a new main road is to be opened some little distance away from his original lot, M.L.430. This, though true, is misleading as thus stated because the proposal was that the Government should pay him the estimated cost of this additional work, i.e., $24,000. It is conceivable that that estimate was too low, though I have no reason for thinking so, but if it was Mr. Kwik should have taken that up as a special point at the time. He definitely accepted this term without question in his letter of 5.1.23, which was a general acceptance of the terms of the Director of Public Works' letter of 2.1.23.\n\n2.\n\nIt may be explained that the above proposal was made because it was considered that it was a better arrangement for the construction of the nullah and that greater protection would thus be afforded to the east wall of M.L.431.\n\n3.\n\nAs Mr. Jackman says in his minute of 15.11.27, \"It is made to appear that certain terms had been forced on Mr. Kwik for acceptance, but he was quite free (either to refuse or to accept) the terms offered by the Government for an extension\". He could have stood on his original contract if he had so chosen.\n\n4.\n\nAs a matter of fact, the Government eventually agreed to contribute $31,837.80 towards the cost of the nullah, and this figure was agreed to by Mr. Kwik. As the Building Authority approved the plans for a rubble mound wall the Director of Public Works must be taken to have approved formally of the rubble mound wall design, and Mr. Kwik appears to have actually let a contract to Lam Woo for the construction of a rubble mound wall. Thereafter Mr. Kwik could have refused to construct a wall of any other design. In fact, he eventually agreed to construct a vertical sea wall.\n\n2.\n\nIt was on 13.6.22 that the Director of Public Works first raised the question of a vertical sea wall. This proposal was referred to the Consulting Engineers, and it appears to have been disclosed to Mr. Kwik about January or February, 1923, because Mr. Kwik refers to it in his letter of 26.3.23 and lays stress on the increased cost and the longer time which the work would require. All through the negotiations Mr. Kwik harps on his main road frontage grievance, speaking in his letter of 21.3.23, e.g., of his \"inherent right\"(!) to a main road frontage. He was evidently anxious to acquire the \"blue\" area between M.L.430 and the proposed new 100-foot road, i.e., area \"C\" plus the land which would have been occupied by the proposed 40-foot road between M.L.430 and area \"C\". Apparently a new lay-out was substituted in the Director of Public Works letter of 4.10.23, though I have not seen the plan, and apparently the Director of Public Works abandoned the lay-out altogether in his letter of 17.10.23. A considerable amount of discussion took place on the various subsidiary terms of the Director of Public Works offer of 11.5.23, and no complete and definite agreement seems ever to have been committed to writing, even in the form of letters, but I think that it would be inferred that an agreement was reached. Mr. Kwik seems to have substantially agreed to the main points, including the vertical sea wall, at a meeting with the Acting Colonial Secretary (Mr. Fletcher) in October, 1923.\n\nThe chief new term was the agreement of the Government to lend Mr. Kwik $600,000.
