(1) The definition of \"strike\" in section 2 is copied from clause 8 (2) of the English bill.\n\n(2) The definition of \"trade union\" gave rise to some difficulty, the English definitions being complicated by the legislative history of trade unions in England. The definition which has been adopted in the Ordinance is based on that in section 16 of the Trade Union Act Amendment Act, 1876, 39 & 40 Vict. c.22. In the peculiar circumstances of Hong Kong it has been considered unnecessary at present to follow that definition in its application to combinations of employers and to combinations for imposing restrictive conditions on the conduct of any trade or business. The reference to branches is taken from section (2) of the Trade Disputes Act, 1906, 6 Edw.7, c.47. The phrase, \"which has among its objects\", is based on section 1 of the Trade Union Act, 1913, 2 & 3 Geo.5, c.30.\n\n4. Sub-section (1) of section 5 is based on section 7 of the Conspiracy and Protection of Property Act, 1875, 38 & 39 Vict. c.86, and sub-sections (2) and (3) of section 5 are based on clause 5 of the English bill.\n\n7. Sub-section (1) of section 6 is based on clause 6(2) of the English bill, the Government of Hong Kong taking the place of the \"local or other public authority\" of the English clause. Sub-section (2) of section 6 deals specifically with the question of notice. Sub-section (3) of section 6, which is aimed at strikes in essential services which are commenced without due warning, is based on section 4 of the Conspiracy and Protection of Property Act, 1875, but it extends the principle of that section to electricity, to telephone and sanitary services, and to the means of transport by railway, ferry, tram and bus. "20\n\nProtection of persons \n\n- 2 \n\n(2) It is hereby declared that any lock-out is illegal if it has any object other than or in addition to the furtherance of a trade dispute within the trade or industry in which the employers locking-out are engaged and is a lock-out designed or calculated to coerce the Government either directly or by inflicting hardship upon the community and it is further declared that it is illegal to commence, or to continue, or to apply any sums in furtherance or support of, any such illegal lock-out. \n\n(3) For the purposes of this section, a trade dispute shall not be deemed to be within a trade or industry unless it is a dispute between employers and workmen, or between workmen and workmen, in that trade or industry, which is connected with the employment or non-employment or the terms of the employment, or with the conditions of labour, of persons in that trade or industry. \n\n(4) Without prejudice to the generality of the expression \"trade or industry\", workmen shall be deemed to be within the same trade or industry if their wages or conditions of employment are determined in accordance with the conclusions of the same joint industrial council, conciliation board, or other similar body, or in accordance with agreements made with the same employer or group of employers. \n\n(5) No person shall declare, instigate, incite others to take part in, or otherwise act in furtherance of a strike or lock-out declared by this Ordinance to be illegal: Provided that no person shall be deemed to have committed an offence under this section or at common law by reason only of his having ceased work or refused to continue work or to accept employment. \n\n4.-(1) No person refusing to take part or to continue to take part in any strike which is by this Ordinance declared to be illegal, shall be, by reason of such refusal or by reason of any action taken by him under this section, subject to expulsion from any trade union or society, or to fine or penalty, or to deprivation of any right or benefit to which he would otherwise be entitled, or liable to be placed in any respect either directly or indirectly under any disability or at any disadvantage as compared with other members of the trade union or society, anything to the contrary in the rules of the trade union or society notwithstanding. \n\nPrevention of intimidation, 38 & 39 Vict. c. 86, s. 7. \n\n(2) Nothing in the rules of a trade union or society requiring the reference of disputes to arbitration shall apply to any proceeding for enforcing any right or exemption secured by this section, and in any such proceeding the court may, in lieu of ordering a person who has been expelled from membership of a trade union or society to be restored to membership, order that he be paid out of the funds of the trade union or society such sum by way of compensation or damages as the court thinks just. \n\n5.-(1) No person shall, with a view to compel any other person to abstain from doing or to do any act which such other person has a legal right to do or to abstain from doing, wrongfully and without legal authority,— \n\n(a) use violence to or intimidate such other person or his wife or children, or injure his property; or, \n\n(b) persistently follow such other person about from place to place; or, \n\n(c) hide any tools, clothes, or other property owned or used by such other person, or deprive him of or hinder him in the use thereof; or, \n\n(d) watch or beset the house or other place where such other person resides, or works, or carries on business, or happens to be, or the approach to such house or place; or, \n\n(e) follow such other person with two or more other persons in a disorderly manner in or through any street or road. \n\n(2) It is hereby declared that it is unlawful for one or more persons (whether acting on their own behalf or on behalf of a trade union or society or of an individual employer or firm, and notwithstanding that they may be acting in contemplation or furtherance of a trade dispute) to attend at or near a house or place where a person resides or works or happens to be, for the purpose of obtaining or communicating information or of persuading or inducing any person to work or to abstain from working, if they so attend in such numbers or otherwise in such manner as to be calculated to intimidate any person in that house or place, or to obstruct the approach thereto or egress therefrom, or to lead to a breach of the peace and attending at or near any house or place in such numbers or in such manner as is by this sub-section declared to be unlawful shall be deemed to be a watching or besetting of that house or place within the meaning of sub-section (1). \n\n(3) In this section the expression \"to intimidate\" means to cause in the mind of a person a reasonable apprehension of injury to him or to any member of his family or of violence or damage to any person or property, and the expression \"injury\" includes injury other than physical or material injury, and accordingly the expression \"apprehension of injury\" includes an apprehension of boycott, or loss of any kind, or of exposure to hatred, ridicule, or contempt. \n\n11\n\n13\n\n6.-(1) No person who is employed in the service of the Crown under the Government of Hong Kong shall wilfully break an agreement for service under the Crown if he knows or has reasonable cause to believe that the probable consequence of his so doing, either alone or in combination with others, would, failing the adoption of extraordinary measures, be to hinder or prevent the discharge of the functions of the Government. \n\n(2) For the purpose of sub-section (1), and without prejudice to the interpretation of any express term of the agreement other than a term relating to notice, a person who is employed in the service of the Crown shall be deemed to break his agreement for service under the Crown if he absents himself from duty without leave and without having given to the head of his department one month's notice in writing terminating with the last day of a calendar month, or if he wilfully refuses duty, or if he wilfully omits to perform his duty, provided that the provisions of this sub-section relating to notice shall not apply to any person who is engaged by the day or who is paid daily. \n\n(3) No person who is employed by any company, firm or person engaged in the business of supplying electric current or gas to the public, or engaged in maintaining any public tramway, bus service, or public ferry, or engaged in maintaining any telephone or sanitary service, shall wilfully break a contract of service with such company, firm or person as aforesaid, if he knows or has reasonable cause to believe that the probable consequence of his doing, either alone or in combination with others, would, failing the adoption of extraordinary measures, be to deprive the inhabitants of the Colony, or a substantial number of them, wholly or to a great extent, of their supply of electric current or gas, or of the ordinary facilities of transport, or of the ordinary telephone or sanitary services. \n\n(4) No person shall wilfully break any contract of service if he knows or has reasonable cause to believe that the probable consequences of his so doing, either alone or in combination with others, would, failing the option of extraordinary measures, be to endanger human life, or to cause serious bodily injury, or to expose valuable property whether movable or immovable to established within the Colony shall be affiliated or connected with any trade union or other organization which is established outside the Colony in such a manner as to place the trade union which is established within the Colony, or any of its members, in any way or in any matter under the control of the trade union or other organization which is established outside the Colony.\n\noutside the\n\nColony.\n\n(2) Any consent of the Governor in Council under the provisions of sub-section (1) may be made retrospective in effect to such date as the Governor in Council shall think fit.\n\n(3) Every trade union so affiliated or connected which has not obtained the consent of the Governor in Council to be so affiliated or connected, or from which any such consent has been withdrawn, shall be deemed to be an unlawful society within the meaning and for all the purposes of the Societies Ordinance, 1920.\n\nNo. 8 of 1920.\n\n(4) It shall be lawful for the Governor in Council in his absolute discretion to declare any trade union which in his opinion is so affiliated or connected, and which has not obtained the consent of the Governor in Council to be so affiliated or connected, or from which any such consent has been withdrawn, to be an unlawful society within the meaning and for all the purposes of the Societies Ordinance, 1920.\n\nNo. 8 of 1920.\n\n(5) Without prejudice to any other method of proof, a trade union shall for the purposes of sub-section (1) be deemed to be established within the Colony-\n\n(a) if it maintains, either continuously or from time to time, any office or any other premises within the Colony;\n\n(b) if it maintains, either continuously or from time to time, any officer within the Colony;\n\n(c) if a sign board bearing its name is displayed at any place in the Colony, whether public or private, unless it is proved that such sign board was so displayed without the knowledge of any officer of such trade union; or\n\n(d) if any document is found in the Colony which purports or appears to be a direction or notice on behalf of such trade union to any person or persons with regard to any action by such person or persons within the Colony, unless it is proved that such direction or notice (i) was issued without the knowledge of any officer of such trade union or (ii) was not intended as a direction or notice with regard to any action by such person or persons within the Colony.\n\n(6) Subject to the provisions of sub-section (8), no person shall on behalf of or in the name of any trade union which is established outside the Colony give or attempt to give, directly or indirectly, any direction or notice to any person or persons with regard to any action by such person or persons within the Colony.\n\n(7) Subject to the provisions of sub-section (8), no person shall without lawful authority or excuse have in his possession any document which purports or appears to be a direction or notice on behalf of or in the name of any trade union which is established outside the Colony with regard to any action by any person or persons within the Colony.\n\n(8) The provisions of sub-sections (6) and (7) shall not apply to any direction or notice issued or given on behalf of or in the name of any trade union which is established outside the Colony to the members of any trade union which is established within the Colony if the trade union which is established within the Colony is with the consent of the Governor in Council affiliated or connected with the trade union which is established outside the Colony.\n\n(9) In any prosecution under this section the onus of proving that any organization in question was not a trade union, or that any organization in question was not a trade union which was established outside the Colony, shall lie on the defendant.\n\n8. It shall not be lawful to apply any of the funds of any trade union to any political purpose outside the Colony, and no person shall require or invite any member of a trade union or any other person to make any contribution to the funds of any trade union for any political purpose outside the Colony.\n\n9. Without prejudice to the right of any person having a sufficient interest in the relief sought to sue or apply for an injunction to restrain any application of the funds of a trade union in contravention of the provisions of this Ordinance, such an injunction may be granted at the suit or application of the Attorney General.\n\n10. Every person who contravenes any of the provisions of this Ordinance shall upon summary conviction be liable to a fine not exceeding five hundred dollars and to imprisonment for any term not exceeding six months.\n\n11. Since last Thursday we have decided to propose three further amendments in addition to those which I then mentioned. Two of these appear on the sheet which was circulated to Honourable Members. The third does not appear on that paper. The two amendments which appear on the sheet that was circulated are amendments proposed to be made in Clause 6. The first is in Sub-section (1) where it is proposed to substitute the words \"an agreement for service under\" for the words \"a contract of service with.\" The clause will then read \"No person who is employed in the service of the Crown under the Government of Hong Kong shall wilfully break an agreement for service under the Crown if he knows or has reasonable cause to believe that the probable consequence of his so doing, either alone or in combination with others, would, failing the adoption of extraordinary measures, be to hinder or prevent the discharge of the functions of the Government.\"\n\nThis amendment is made in order to make the terminology of the clause agree better with the terminology of General Orders. It also serves to mark the distinction between the terms of service under the Crown and the terms of service under some employer other than the Crown. Service under the Crown differs, of course, in a number of its details from service under any other employer, the great distinction being that, speaking generally, to every agreement for service under the Crown there is the implied condition that the Crown is at liberty to dispense with the services of its servants at any time.\n\nThe second amendment proposed to be made in Clause 6 is the addition of a new sub-section (2). The new clause originally proposed was \"No prosecution for any offence under Section 3, 7 or 8 shall be commenced without the sanction of the Attorney-General.\" It is now proposed to move in committee that the clause shall read \"No prosecution for any offence under Sections 3, 6, 7 or 8 shall be commenced without the sanction of the Attorney-General.\" It has been deemed desirable to include section 6 in the terms of the proposed section.\n\nTHE COLONIAL SECRETARY proposed the second reading of the Bill.\n\nHON. SIR SHOU-SON CHOW said-Sir,-As this Bill affects the Chinese more than other sections of the community by reason of their preponderate numbers, I crave permission to make a few remarks on behalf of myself and my Chinese colleague. We consider the Bill timely and necessary, and we therefore support it whole-heartedly. If and when it becomes law, it should go a long way towards preventing recurring political strikes-strikes which specially aim at the economic life of the Colony, such as those which we experienced in 1922 and 1925, and from the effects of which we are still suffering.\n\nThe proposed measure is not class legislation, because it affects employers as well as employees; nor is it in any way racial discrimination, for it concerns all, irrespective of race or creed. The fact that many of its sections are taken from the Bill now before Parliament proves conclusively that the Government has no intention of treating the Chinese differently from the British. If this Bill in any way savoured of class or racial distinction, we would have been the first to oppose it. It will, in fact, afford protection to the employees no less than to the employers, for it makes lock-outs illegal under certain defined circumstances. In short, it is legislation designed to protect the community as a whole. I say that not only is it not aiming at the labouring classes, but one of its basic principles is to afford protection to the law-abiding workmen who only want to be left alone to earn an honest living.\n\nStrikes are double-edged weapons which injure the strikers just as much as the people they strike against. They cause untold losses, and widespread distress and misery to all classes. Thousands and thousands of honest working men have in recent years been forced to go on strike, to give up their means of livelihood, at the dictates of a few individuals who batten on the ignorance and gullibility of the masses. It is this class of mischief-makers, fomenters of sedition and trouble-that this Bill is designed to deal with. Hong Kong is no place for them. We do not want Bolshevism or Communism. What we want are peace and good order, and the right to follow our callings without let or hindrance.\n\nThis Bill is in no way a repressive measure. It will not interfere with the law-abiding working men; it does not even make economic strikes illegal, and, further, it does not prohibit sympathetic strikes, as such.\n\nIn the event of a wage dispute between employers and employed, the mediation of the Government can be invoked by the two parties to bring about a satisfactory settlement. The efforts of my Chinese colleague and myself can also be counted upon to that end, if desired. We are not unmindful of the legitimate aspirations of the working men to better their conditions of living. But the realisation of such aspirations can only be possible if the Colony enjoys peace and prosperity, if its industrial life pursues a normal course, and if Capital and Labour loyally co-operate for a common purpose. I believe, in all sincerity, that this Bill, more than anything else I can conceive of at the present time, will materially help to bring us these blessings. (Applause.)\n\nHON. MR. W. E. L. SHENTON said—Your Excellency, I rise to support this proposed ordinance because it will contribute to the peace and good order of this Colony. It is one of the principal duties of the Justices of the Peace of this Colony to assist in the preservation of peace and good order and it is, therefore my wish as the representative of that body to support this proposed legislation.\n\nIt is needless for me to point out that Hong Kong is peculiarly situated on the borders of China and that in the heat of political movement it is particularly sensitive to political emotion. It is essential, your Excellency, in this Colony that we should entirely control our own house. It is equally essential that there should be no interference from without. It is also essential that we should preserve some control over our own people and their connections and associations outside the Colony.\n\nThe main section of this Ordinance is Section 3 which states that either a strike or lock-out designed or calculated to coerce the Government is illegal. Those words \"designed or calculated\" do not mean that there must be actual coercion. As to whether the strikes in 1922 and 1925 were illegal strikes, or would have become illegal strikes, under this Ordinance, it is unnecessary for us to argue. We can at the most surmise. They are old history. But it is particularly desirable that there should be a statutory declaration as to what an illegal strike is.\n\nThe principal objects and merits of this proposed Ordinance are in Sections 3, 4, 5, 6, 7, 8 and 11. Section 3 is the section which deals with illegal strikes and illegal lock-outs. It is, I may say, declaratory of the law as it exists to-day. It has been held at Home, in the Courts, that strikes and lock-outs such as are indicated in Section 3 are in fact illegal irrespective of this section. I would interpret this section as one upholding the principle that the Government must not be forced to do what it does not consider right. This legislation is directed towards that end.\n\nSection 4 is a section which deals with the protection of the individual. It is framed with the object of assisting any inhabitant of this Colony who wishes to observe the law. That is to say if he refuses to take part in any strike which is declared illegal he shall not be subject to fine or otherwise deprived of any right or benefit to which he might be entitled. I would describe this section as giving the right to the individual to carry on his advocations according to his own wishes.\n\nSection 5 is the section which deals with intimidation. This section does not in any way effect what is known as peaceful picketing. That is preserved, but it states very clearly and emphatically what will not be allowed. This again, Your Excellency, is declaratory of the law as it exists to-day, but it is extremely useful to have the declaration placed on the Statute book so that all may know. I regard this section as the acknowledgment of the right of the individual to exercise his own discretion.\n\nSection 6 deals with breaches of contract. This is specially framed to stop what are known as lightning strikes in essential services. I may well describe this section as the section for the protection of the public.\n\nSection 7 gives to this Colony the right to regulate its own affairs without interference from without. I would describe this section in a few words as embodying and assisting the preservation of the independence of this Colony.\n\nSection 8 is the section which prohibits the use of trade union funds for political purposes outside the Colony. It is, if I may say so, a section based upon the necessity of maintaining our neutrality. Our inhabitants should not unduly interfere with politics outside the Colony and this section is a contribution to the maintenance of neutrality in political affairs which at this particular juncture is so essential.\n\nSection 11 provides a safeguard against frivolous prosecutions. It acts as a guarantee in this Colony that the law will be properly administered. It is essential that we should have a section of this nature because it assures that legal strikes and legal lock-outs will not be interfered with. This section provides that there shall be no prosecutions without good cause.\n\nIn conclusion, I would point out that this Ordinance places no restriction whatever on genuine trade disputes nor upon the common law rights of individuals. It merely provides that lawful objects shall be carried out by lawful means and for that reason I have great pleasure in supporting it. (1) No person refusing to take part or to continue to take part in any strike which is by this Act declared to be illegal, shall be, by reason of such refusal or by reason of any action taken by him under this section, subject to expulsion from any trade union or society, or to any fine or penalty, or to deprivation of any right or benefit to which he would otherwise be entitled, or liable to be placed in any respect either directly or indirectly under any disability or at any disadvantage as compared with other members of the union or society, anything to the contrary in the rules of a trade union or society notwithstanding.\n\n(2) No provisions of the Trade Union Acts, 1871 to 1917, limiting the proceedings which may be entertained by any court, and nothing in the rules of a trade union or society requiring the reference of disputes to arbitration shall apply to any proceeding for enforcing any right or exemption secured by this section, and in any such proceeding the court may, in lieu of ordering a person who has been expelled from membership of a trade union or society to be restored to membership, order that he be paid out of the funds of the trade union or society such sum by way of compensation or damages as the court thinks just.\n\nTrade Disputes and Trade Unions.\n\n(3) As respects any strike before the passing of this Act which is declared by this Act to have been illegal, this section shall have effect as if it had been in operation when the strike took place.\n\n3.-(1) It is hereby declared that it is unlawful for one or more persons (whether acting on their own behalf or on behalf of a trade union or of an individual employer or firm, and notwithstanding that they may be acting in contemplation or furtherance of a trade dispute) to attend at or near a house or place where a person resides or works or happens to be, for the purpose of obtaining or communicating information or of persuading or inducing any person to work or to abstain from working, if they so attend in such numbers or otherwise in such manner as to be calculated to intimidate any person in that house or place, or to obstruct the approach thereto or egress therefrom, or to lead to a breach of the peace; His wife was born in Russia on the 27th September, 1900. In 1926 they were repatriated at the public expense from Marseilles on their journey to this country from Shanghai. The cost of their repatriation has never been refunded.\n\nOn the 2nd July last passport No.212784, valid for one year and endorsed for Europe and the Union of Soviet Socialist Republics, was granted to Lock and his wife to enable them to proceed to her home in Vladivostock. She was stated to be in a bad state of health. Lock was warned that his wife would not again be repatriated at the expense of public funds. His father refuses to afford him any further assistance.\n\nIn July last they reported to the British Consul at Berlin that they had lost a pocket wallet and all their money. On the strength of Lock's statement, subsequently found to be untrue, that he owned a business in Winnipeg known as the Russian Beauty Products Company, assistance was given to them. A similar tale was told to His Majesty's Consulate-General at Moscow, where they also obtained assistance. He was at that time working for the Shanghai Municipal Council in the Police Force. He lost his job shortly after our marriage and then for two or three years he was working for various firms. He never seemed to be able to hold a job for any length of time. We both went to England at the end of 1926.\n\nAfter about ten months' holiday there we went to Canada where we remained for about four years. I had a beauty parlour there and my husband helped me in the sale of my own beauty preparations.\n\nIn 1930 we returned to England and three months later we set out to return to the Far East via Siberia. We were then travelling on a joint British passport. There was some trouble in Moscow because we had lost our money and we had to ask the British Consul for assistance. He gave us money to continue to Vladivostock where I had relatives. We stayed at that port for about five months as my husband obtained a job on the docks as a stevedore.\n\nMy husband decided that he could not continue to work in Vladivostock so we went to Shanghai. I started another beauty business there making my own preparations and selling them. My husband worked occasionally but he never seemed to be able to stay in any job for any length of time and I more or less supported him for several years. I then found out that he was getting assistance from the St. George's Society and also from his father and as he had not mentioned anything to me about it, I was very angry.
