For collating this his Papers together I have, indeed, trouble in collating them with each other.\n\nYou describe Mr. Hulme as a Political drunkard, and state that you have yourself witnessed and deplored that fact. You designate him as \"Filonus\" and contrast this value with the value of his services.\n\nThis is a difference which I am at a loss to understand between the language of which you term \"the officious or complacent though this vigilant accused\". A conclusion or inference which you have drawn from the testimony of others, and not as a matter of fact which you had yourself witnessed.\n\nInstead of sticking to this charge of habitual drunkenness you have now alluded to what's related at \"the Complaint\" (whatever that may be) and some accusation which took place on the one occasion of Keying's last visit to Hongkong (a circumstance that may have been).         "content_text": "# Enclosure 3\n\nExtract from the \"South China Morning Post\" of the 8th June, 1905\n\n## ON A RUSSIAN CRUISER\n\n### Experiences of the Captured Crew of the Oldhamia\n\n#### Chief Officer's Interesting Narrative\n\nYesterday the Douglas Steamship Company's s.s. Haiching landed in the Colony 28 distressed British seamen, part of the crew of the British steamer Oldhamia, which, as already reported, is supposed to have been sunk by the Baltic Fleet.\n\nA representative of the \"South China Morning Post\" succeeded in obtaining an interview with Mr. James Ison, chief officer of the ill-starred vessel, who kindly furnished a highly interesting and detailed from-day-to-day account of the adventure.\n\nMr. Ison, after stating that he had just concluded a recital of his experiences to His Excellency the Governor, went on as follows:\n\nThe Oldhamia is a British steamer of 2,347 tons nett register, and she was bound from New York to Yokkaichi in Japan with a cargo of case oil. Our last port of call was Port Said and, when we entered the China Sea, we had no thought of anything but the speedy termination of our long voyage. Everything went well until the evening of May 18, when, to our utter astonishment, we sighted the Baltic Fleet comprising 48 ships. We were quickly signalled to stop by the cruiser Oleg. Our first feelings were of wonderment that the Baltic Fleet still existed in such strength. Previous to leaving Port Said, we heard that they had passed through the Malacca Straits and we were surprised to find that they had not yet met the Japanese. We were confident that, when they met the Japanese, there would not be much left of them and subsequent events have justified our belief. Our feelings quickly changed to annoyance and dismay.\n\nThe Oldhamia was boarded by the officers of the Oleg who, after examining the papers and interviewing the captain, exchanged signals at length with the Fleet. The order was then given for the Oleg and the Oldhamia to join the Fleet and keep in company with it. We were astounded when we found that the ship was to be detained. Captain Stewart strongly protested, but no notice whatsoever was taken of him. From the very moment they came aboard, I surmised that their minds were fully made up to keep the ship.\n\nAt six o'clock on the morning of the 19th, the Fleet stopped about 150 miles south of Formosa. (When we met the Fleet, I omitted to say, we were making for the Bashee Channel.) We were boarded by several officers and many men from different ships. Some men opened the hatches and started to take cargo out with the idea, I presume, of ascertaining its nature. Later in the morning, after an exchange of signals, a collier was sent alongside the Oldhamia and commenced to transfer coal into the Oldhamia's bunkers. At eleven o'clock, the whole crew, with the exception of the captain, chief engineer, steward, and cook, were ordered to leave the ship, which they did, and were transferred to the cruiser Dnieper, formerly the St. Petersburg, the famous Volunteer Fleet cruiser connected with the P. and O. Malacca hold-up. Department and Corps |  |  |  |  |  |  |\n\n## (b) Colonial CONTRIBUTION\n\nThe Colony contributed $1,562,650.27 (being the statutory contribution of 20 per cent. of the Estimated revenue including arrears on account of 1904) towards the cost of the maintenance of the Regular Forces in the Colony and Barrack Service.\n\n## (c) VOLUNTEER CORPS\n\nThe total establishment of the Corps is 431 of all ranks. The strength on the 31st December, 1905, was 276, made up as follows:- Staff, 7; two Garrison Artillery Companies, 205; one Engineer Company, 35; Troop 29.\n\nThe members of the Corps are now all armed with the new M.L.E. Short rifle and the latest pattern equipment.\n\nThe period for the annual Camp of Instruction was extended from 10 days to 16, it was held in October, 1905, and was very well attended.\n\nThe Hongkong Volunteer Reserve Association numbered two hundred and thirteen members at the close of the year, an increase of 113 members, as compared with 1904.\n\nMembers of this Association, who must be over 35 years of age, are required to make themselves proficient in rifle shooting, and undertake to enrol themselves under the Volunteer Ordinance in the event of hostilities.\n\nThe expenditure on the Volunteers, which is entirely borne by the Colony, was $58,311.12.\n\n- 13 -\n\n# XII-GENERAL OBSERVATIONS\n\nThe war between Russia and Japan continued during the first half of the year to affect disadvantageously the trade of the Colony and to be productive of incidents involving important questions of law. Early in January a breach of a Colonial Ordinance required the forfeiture of a cargo of ammunition destined for a belligerent but carried by a British steamer that had put into the port for coal. The position of one of the belligerent fleets from the middle of April to the middle of May within three days' steam of Hongkong necessitated stringent measures being taken to prevent any use of the port not in accordance with British neutrality laws and in several instances the severe penalties involved by the despatch of any ship with reasonable cause to believe that the same would be employed on the naval service of a foreign state at war with a friendly state had to be brought to the special notice of shipping agents. The departure northwards of that fleet relieved anxiety in this matter but was followed by the capture, on the grounds of carrying contraband of war, of two British ships - the `Oldhamia` in the Bashee Channel on May 18th and the `St. Kilda` a few hours out of Hongkong on June 4th. The latter capture was the last incident of the naval operations which directly affected Hongkong though it was not till nearly three months later that the armistice protocol was signed on September 1st. The opportunity was taken of the first visit to the port after the conclusion of peace of a Russian war vessel - the `Almaz` - to embark on her on November 30th for repatriation the 2 officers and 53 men of the former Russian torpedo boat destroyer `Burni` who had arrived in the Colony from Wei-Hai-Wei on the 22nd August, 1904. 2 officers and 8 men who had formed part of the same crew had previously been sent to Europe on grounds of ill-health.\n\nThe result of the disappearance of Russian naval power from Far Eastern waters was the immediate withdrawal of all the battleships from the British fleet on the China Station and a reduction in the number of cruisers. The lessening of imperial expenditure in the Colony resulting from this has necessarily been disadvantageous to its trade.\n\nThis was more seriously affected by the organized attempt of the Chinese in the last half of the year to boycott American goods as a protest against the administration of the United States law excluding Chinese labourers from that country. The attempt to extend the organization of the movement to this Colony was not supported by the principal Chinese merchants here, but its strength in Canton adversely affected the business in American goods which passes through Hongkong and further tended to the development of anti-foreign feeling and consequent unrest in that part of China with which Hongkong does most trade. Advantage was taken of the visit in September of Mr. WILLIAM H. TAFT, United States Secretary for War, to give that gentleman an opportunity of hearing the views of some of the leading Chinese of the Colony as to the Chinese objections to the provisions and administration of the exclusion law.\n\nUncertainty of exchange is always a factor adverse to trade and the year under review was not exceptional in this respect, the range of variation being slightly greater than in 1904. The year started with the dollar at 1s. 11d. It fell to 1s. 10d. at the end of March, rose irregularly to 2s. 1d. at the end of November and stood at 2s. 0.25d. in the last days of December. The maximum of the year was the highest value that had been attained since early in 1897.\n\nProbably the most important factor in making the year a bad one for trade was the loss of confidence in Hongkong Chinese dealers owing to the speculation of 1904 which had the natural result of making it difficult for these dealers to get money with which to carry on their business in 1905. As regards imports, trade was particularly slack in fancy cotton and woollen goods and metals while but a limited business was done in Manchester piece goods. Yarns did fairly well, especially for importers. Australian flour entered into serious competition with American of which the importation fell off largely; American kerosine also suffered from the boycott. As regards exports, trade in silk was adversely affected by various causes and in other articles, especially ginger and soy, compared unfavourably with that of preceding years.\n\nIn spite of indifferent trade several local stocks stood higher at the end than at the commencement of the year. Hongkong and Shanghai Banking Corporation shares advanced $150 against an advance of $50 in 1904. Local shipping companies retrograded. Marine insurance shares generally improved. Of the local land and building companies the shares of one operating at Kowloon slightly appreciated; the others declined and the decision of holders of marine lots on the East Praya not to undertake for the present the reclamation of the sea bed in front of their properties was probably a wise one.         "content_text": "I am willing to accede to a Condition which they stipulate. \n\nThe answer would have to be that the resolution stipulation was subject to an implied condition that the Condition would be fulfilled in a reasonable time, that a reasonable time has elapsed, & that therefore the approval is vacated. \n\nEven if such a stipulation can be read into the resolution I am not certain a Court would find that a reasonable Time has elapsed having regard to the war & the restrictions on raising Capital. \n\nIt might also be said that the condition was incapable of performance by the Company - but there again the position would be uncertain. \n\nI think the best course would be for the Leg. Council to Consider the matter afresh & resolve that as a reasonable Time has elapsed & the Condition is not fulfilled, they are unable to adhere to approval, which is accordingly lost or void. \n\nThen give notice thereof to the Promoters stating that in that case the agreement must be regarded as Cancelled. \n\nI think it is arguable that so long as the Condition is unfulfilled the approval to execute is executory or capable of being withdrawn. \n\nI am sorry to have made this long note but the Govt. may just as well do the thing in a way involving the minimum of risk of a difficult lawsuit.         "content_text": "## GOVERNMENT HOUSE, HONGKONG. 17th June, 1927.\n\nSir,\n\nWith reference to your despatch No.83 of 2nd April, 1927, on the subject of the contribution by the Hong Kong Government towards the cost of the Singapore Naval Base, I have the honour to forward copy of a letter from the Auditor on the question of the disposal of the sum of £14,517.0s.6d, being interest accrued on the special fund established for providing the Colony's contribution of £250,000.0s.0d.\n\n2. The contribution was fixed at £250,000, and the Lords Commissioners of the Admiralty requested that the whole sum should not be paid over at once but as required and as expenses were incurred. There can be, I regret, no question of increasing that contribution under the conditions now obtaining in Hong Kong.\n\n3. Interest on the money received from the Shipping Control has always been credited to the Hong Kong General Account, and I entirely concur in the directions given in Colonial Office letter No.`30041/27` of 29th March, 1927, that the accrued interest on the capital sum should be transferred to that same account.\n\n4.         "content_text": "## No.45.\n\nCopy-10\n\n**Audit Department, Hong Kong.**\n\n17th May, 1927.\n\nSir,\n\nI have the honour to address you with reference to the Secretary of State's Despatch, Hong Kong 83 of the 2nd April, 1927, on the subject of the contribution by the Government of Hong Kong towards the cost of the Singapore Base, enclosing a copy of Colonial Office Letter No.3004/27 of 29th March from the Under Secretary of State to the Crown Agents for the Colonies, in which the Crown Agents are directed to transfer to the credit of the Hong Kong General Account the sum of £14,617.0.6, representing accrued interest on the capital sum of the contribution made by the Government of Hong Kong.\n\n2. It is with considerable diffidence, in view of the correspondence quoted, that I raise the question of the transfer to Hong Kong Account of the interest on the Colony's contribution to the Imperial Government towards the cost of the Singapore Base. It will, however, be observed on referring to the correspondence in `C.S.O.2921/25` that His Excellency The Governor, (Sir R. E. Stubbs, K.C.M.G.) made a definite gift, on behalf of Hong Kong, of the sum of £250,000. Stubbs, by telegram dated 14th March replied: \"I should prefer to hand over the whole amount at once in order to get rid of cross entry in Balance Sheet. Suggest the Crown Agents should transfer Investments to His Majesty's Government so that nothing passes through our Revenue and Expenditure Accounts.\"\n\nIn Colonial Office Despatch No.104 of 23rd March, 1925 to the Governor of Hong Kong (with enclosure C.O. Letter No.11945/24 of 19th March, 1925, to the Crown Agents) it will be observed that apparently to meet the wishes of the Lords Commissioners of the Admiralty, arrangements were made whereby Hong Kong's Contribution should be vested by the Crown Agents in a Special Fund, from which, from time to time, advances by way of instalments on account could be made, and according to Crown Agents' Letter `A/862` of the 1st April, 1925, the necessary action was taken for the transfer of £250,000 from the Hong Kong Account to the \"Special Fund\".\n\nIt will be further observed from the Colonial Treasurer's minute of the 2nd July, 1925, in `C.S.O.2921/25(3)`, \"The money is out of our hands, and off our books\".\n\n### 3\n\nOn reviewing the correspondence referred to, I am led to believe that it was the definite intention of this Government to donate the gift as a whole sum.         "content_text": "### 3.\n\nIn my opinion, purely for the convenience of the Admiralty, and it would therefore appear, if my contention is correct, that the Admiralty would have priority of claim to any accrued interest. In this connection, I would refer you to the enclosure in `C.S.O.2921/25`, a copy of Parliamentary Debates, House of Lords, Vol. 61, No. 58 of 1st July, 1925, page 909, where the Civil Lord of the Admiralty, Earl Stanhope, is quoted as having said, \"As to the generous gift of £250,000 by Hong Kong, that money was given under no conditions except that it was naturally for the development of the base.\"\n\n### 4.\n\nAs a considerable time has elapsed since the gift was made, and considerable changes in the personnel have occurred in the Administration of the Government, I hope you will not consider it out of place if I make a few remarks regarding what, I believe, was the underlying principle which prompted this Colony to make the gift to the Imperial Government.\n\nDuring the late War, there was a scheme of local shipping control from which a very considerable profit accrued to this Government, amounting, I believe, to about two and a half million dollars. After the War, there was a diversity of opinion as to the rightful ownership of this profit, which led to some controversy, but which happily, since the gift was made for the Singapore Base, has relaxed, with the exception of an occasional reference by a few of the \"Diehards\".\n\nI believe it was, therefore, considered more politic to place the money at the disposal of the Imperial Government to be utilized imperially, rather than retain it to meet local expenditure.\n\nPage 84\n\n### 5.",

        "content_text": "Go Secret @)\n\n16/1/28\n\n(Repeat recent development)\n\nPermission was granted in Nr. 1926 to Messrs Stagarhi & Co of Nagerate to base a high-class trading business in Stayhang, but the scheme was never proceeded with.\n\nIn June 1947 a Mr. Kilagama, a Japanese merchant resident in Hong Kong, was granted permission to carry out a similar scheme.\n\nI have discussed the scheme with Mr. Dee in Dec 1947 who was engaged to develop it, but failed to obtain affiliation.\n\nMr. M. Sekeji Itanada was interested in a similar enterprise.\n\nTomisia has reported that he intended to notify them that unless he had started his business by Jan 1928, the permission originally granted would be withdrawn.\n\nIt was suggested that there permits might be made use of for a similar concern for the Japanese, so that a worthwhile Fishing industry might be encouraged to carry out deep sea fishing based on Hongkong.\n\n29/2\n\nIf there is anything in this traffic, it is a matter for alarm, as it is undesirable that firms should cloak their activities, as it must be a cloak for espionage.\n\nSampling any launch doubt if the Japanese and allow them to fish in their waters.\n\nA 28/2 PTO",

In the particular case under consideration, permission has been granted subject to the business having been started by the 10th August, 1928. The Colonial Secretary of the Hongkong Government has, however, informed the Japanese Consul General that no further applications of this type can be entertained.\n\n2. The question arises whether, in view of the provisions of the Anglo-Japanese Treaty of 1911, to which Hongkong is a party, the Governor has the right to refuse permission to a Japanese subject to establish himself in Hongkong for this purpose. The Hongkong Merchant Shipping Ordinance of 1899 gives him power to make regulations for the management, working and control of all fishing operations generally in the waters of the Colony (Article 29 (4)); it also empowers him to make regulations for licensing launches of the type proposed to be used by the Japanese (Article 37). The present application, however, concerns fishing not in territorial waters but on the high seas, and is therefore not covered...\n\nThe Secretary to the Board of Trade.",

It is possible, therefore, that the Japanese could claim national treatment in respect\n\nof facilities for fishery on the high seas under the\n\nprovisions of Articles 1, 6 or 17 of the Treaty.\n\nIf 19.\n\nit is not clear upon what ground the Governor could refuse\n\nthe permission requested, subject of course to the\n\nobservance by the Japanese of municipal laws and regulations,\n\nunless such permission might in similar circumstances be\n\nrefused to a British subject, and of this there is no\n\nevidence. It is difficult, therefore, to see why the\n\nJapanese should require permission to establish a business\n\nof this kind, though they certainly seem to assume that\n\nsuch permission is necessary.\n\n2. CONSULATE GENERAL,\n\nMEMORANDUM.\n\nHONG KONG.\n\n26\n\nHayashi and Company of Nagasaki, Japan, has the plan of conducting fishery with ten motor-boats on the high sea extending about 150 to 250 miles South-West of the Island of Hong Kong, and, in connection with the project, they desire to have headquarters of the activities here in Hong Kong with this port as the base of their fishing boats by the special permission of the Colonial Government.\n\nTheir object in the proposed industry is to supply to the inhabitants of this Colony with various kinds of fishes at the lowest possible price, in view of present shortage of such food supply. They state that they have no objection to the participation of Chinese, if there is any such, in their enterprise, and that they are considering also employing Chinese as staff officials of the Company.\n\n1. Further details of their plan are as follows:-\n\nAgent in Hong Kong of the Company will be Yokose and Company.\n\n2. Method of fishing is by operating motor boats drawing a fishing net at its bottom.\n\n3. Number of motor boats (tonnage 45 tons, 80 horse powers, and number of the crew 10 for each) to be employed for the proposed fishery is ten, each two of which forming one group.\n\n4. Number of trips of each group will be three per month.",

This firm must be identical with Hayashi Kane Shoten, whose head office is at Shimonoseki with a branch here as Hayashi & Co., of Nagasaki is unknown.\n\nIf I am correct Hayashi Kane are well known in the Japanese fishing industry. The paid-up capital of the firm is Yen 7,500,000 with a reserve fund of Yen 351,000. Kitayama, a Japanese merchant resident in this Colony, has expressed his desire of continuing such fishing business on the entirely same scale as that of Messrs. Hayashi and Co. and for that he plans to have the headquarters of the fishing vessels in the Harbour of Hong Kong.\n\nI have the honour to bring the above to your knowledge, and shall be highly obliged if your Government would be good enough to give a grant, as was given to Messrs. The said Japanese has already brought two boats to this Harbour to start fishery as an experimental and partial work of his enterprise.\n\nIn connection with the above, I have the honour to request that you will be good enough to inform me whether the business in question will be allowed by your Government or not.\n\nFor your information, I beg leave to add that, at present, there is no Japanese engaged in fishery making this port as a basis. In spite of the permission kindly granted by your note of the 25th August, 1926, and of the 10th August, last, respectively, Hayashi-Kane & Co., have ceased their fishery early in this year chiefly on account of the defects in management, and Mr. Kitayama is still unable to start fishery on account of the delay in building the boats needed. Personal Standing:-\n\nTakeji Hamada,\n\nNagasaki, Japan,\n\n73, Praya East, Hong Kong,\n\nHe originally served as a captain on a merchant ship. Now he is going to start fishery. For that purpose, he came lately to Hong Kong.\n\nThe capital allotted to the project at present is about ¥70,000, of which ¥60,000 consists of the two boats now in the harbour.\n\n2. Method of fishery.\n\nDraw a net by two motor-boats in the high sea to catch fishes.\n\nThe net is of one square inch, having five and a half knots in five inches length.\n\nThe boat is of nearly fifty gross tons, being equipped with a semi-diesel engine of 80-100 horsepower.\n\nThe fishery is to be worked in the high sea within a semi-circle at a distance of nearly 400 miles from Hong Kong.\n\n3. Business in Hong Kong.\n\nMaking Hong Kong the basis of the work, he will supply the boats with utensils, food, provisions, and water, all indispensable for carrying out fishery in the sea.\n\nHe will land the fishes from the boats and sell them to local dealers in the market.\n\nHe will settle in Hong Kong to look after the business. He will strictly observe the laws and regulations of the Hong Kong Government.\n\nHe has no objection to co-operating with any British or Chinese businessmen interested in fishery.\n\nNearly three times per two months, the boats are expected to come into the harbour with fishes on board, which are expected to amount approximately to forty thousand kins.\n\nHis plan is to expand the enterprise gradually to the extent of using ten boats regularly.",

I feel, however, that it would be wise to state definitely that no further applications can be considered, and that Mr. Kitayama's permit will lapse within a definite period unless he can make use of it.\n\nThe reasons for this could be explained by pointing out that too efficient a fishing trade would undercut the prices obtained by local Chinese fishermen and cause them great hardship. The more these men are thrown out of employment the more likely they are to turn to piracy.\n\nI would suggest that the matter be brought to the notice of the Secretary of State for the Colonies and through him at my request to the Admiralty. It is possible that His Majesty's Government might make use of this to obtain a similar concession from the Japanese and in any case in considering distances of 400 miles it seems to me to be immaterial whether Formosa or Hong Kong is used as base.\n\nApart from the above it is just possible that His Majesty's Government might encourage a British Fishing Company to carry out deep sea fishing based on Hong Kong. After\n\n(Enclo's.2 & 3) reference to the British Consul at Nagasaki and (Enclo.4)\n\nconsultation with the then Naval Commander-in-Chief\n\n(Enclo's.5 & 6) I saw no good reason for refusal and informed the\n\nConsul-General accordingly.\n\n(Enclo.7)\n\n4.\n\nThe scheme never came to fruition and\n\nin June, 1927, an application from a Mr. Kitayama, a\n\nJapanese merchant residing in this Colony, was received\n\nfrom the Consul-General. Permission was asked to\n\ncarry out the scheme of Messrs. Hayashi and Company (Enclo's.8 & 9) who had dropped out. To this I gave my consent.\n\n(Enclo.10)\n\n(Enclo.11)\n\n(Enclo.12)\n\n5.\n\nMr. Kitayama however has also failed to\n\ndevelop the scheme and on 21st December, 1927, I\n\nreceived an application through the Consul-General\n\nasking permission for a Mr. Takeji Hamada to engage\n\nin a very similar enterprise.\n\n6.\n\nAfter consultation with the present\n\nNaval Commander-in-Chief I have again seen no good\n\nreason for refusal and I have replied granting the\n\npermission requested. I have however insisted on\n\nthe development of Mr. Kitayama's scheme within\n\none year of the date on which permission was originally\n\ngranted to him, otherwise Mr. Kitayama's permit will\n\nlapse.\n\n7.\n\nThere seems no valid reason for\n\nsuspecting any ulterior motive, but I agree with the\n\nview of Vice-Admiral Sir Reginald Tyrwhitt that the\n\nfacts should be reported to you for your information\n\nand for transmission to the Lords Commissioners of the\n\nAdmiralty.\n\n8.",

The existing practice is not generous, with offices having to suit General Orders within seven days. However, they do seem to me to be in my way unobjectionable, and the modified practice would still be comparatively generous.\n\nThe subject is to amend the rule regarding officers returning from leave. An officer must return to Hong Kong on the boat leaving at or before the expiration of his leave. Any unused leave will be cancelled.
