APPEAL COURT SURPRISE:
MAN ASKED
FOR HEAVIER SENTENCE
'
There was a departure from the usual run of appeals against sen- tences today when an appellant asked for an increase in his sentence before Mr Justice C. W. Reece in the Appeal Court.
The reason for this came to light when Mr W. A. Blair-Kerr, Senior Crown Counsel, informed the Court that prisoners who received terms of more than one year were entitled to learn a trade in prison, and he' thought this was why the man sought a heavier sentence.
Appellant, Kwong Ping, who had been given nine months' hard labour in Kowloon Court for stealing an electric fan from a shop in Nathan Rond, con Armed this.
He added that since he had been in prison so long he felt himself useless to society, so he begged the Court to send him to gaol for a longer term. Further- more he said he had no family here.
Mr Blair-Kerr said appellant hind five previous convictions, and was also a depontee, Appel- Jant would be deported again when he comploted his sentence, he said.
Hls Lordship pointed out 10 appellant that he had been deported from the Colony and asked why he had returned.
Appeliant replied that each time he had been deported he had merely been taken to Futau- mun (in the New Territories} and loft thoro. He said he had never been put into China. If ho had been sent to China ho would have stayed, even if he had to beg.
