IMMORAL CHARGE QUASHED BY APPEAL COURT

Allowing the appeal and quashing a conviction for living on the immoral earnings of a woman, Mr Justice Williams, Senior Puisne Judge, in the Appeal Court this morning, remarked that he was not satisfied that the evidence in this case was satisfactory enough for him to uphold the conviction.

Appellant was Suen King-yuk who appealed against conviction by Mr Poon Yan-hoi at Central. Suen was given three months for living on the immoral carnings of a woman, Ma Fong-chan, over a period between February 1, 1951, and June this year.

Suen, who claimed that he had been falsely accused and wrongly convicted, said that on return after being banished he found that hi wife was living at an hotel immorally. He did not approve, tried to prevent her, but did not succeed in contact Ing her. But certain informa- tion was conveyed to her, and having a grudge against him (Suen) she spread it to the Police and put up a story about himself and Ma Fong-chan. And this led to his imprisonment.

If the evidence was correct | that he had been visiting her then surely it would have been possible to produce some other witnesses in addition to the com- plainant. The accused had made short statement denying the charge.

"I am not antisfied that the evidence in this case is satisfac tory enough for me to uphold the conviction.

I allow the appeal and the conviction is quashed."
