ARTHUR FUNG MURDER: JUDGE ORDERS RETRIAL

The Dr Fung Murder Trial in the Criminal Sessions took a dramatic turn this morning when the Trial Judge, Mr Justice. Gould, ordered a re- trial of the two men accused of the alleged crime.

His Lordship told the Jury of six men and a woman that he had come to the conclusion that they must be discharged at this stage from returning any verdict on the indictment. The accused would be remanded in custody for retrial at the next Sessions. New Counsel would be assigned to each accused.

"will not go into the reasons behind this step, and it is unfortunate that your time has been wasted," his Lordship continued. "But if I go into the facts and if they are published they might prejudice the accused in their new trial. You can rest assured that it is the only step I can take in the interests of justice, and from the point of view of the public and of the accused. You are therefore discharged from further attendance."

Mr Rubin took cut an origina- ting summons and this he was now applying to be dismissed. The two accused were Yuenį volver ordered two umalis nour Further negotiations, said So, 27, and Lau Wah, 22, casual the kitchen into the bedroom of Counsel,
