Defence Claims HK Courts Have No Jurisdiction
A submission that the Courts of Hongkong' can have no jurisdiction to make a declaration sought in an action involving immovable property situated in a foreign land, such as that under dis- -pute, was made by Counsel for defence when hear- ing in the action in respect of the Hardoon Build- ing continued before the Chief Justice, Sir Gerard Howe, in the Supreme Court this morning.
Plaintiff claims that by an agreement entered into between him and defendant in Hongkong on February 28 last year, the Hardoon Building, situated at the corner of Honan Road and Nanking Road, Shanghai, was sold to him at the agreed price of HK$65,000. He is seeking a declaration from the Court that the defendant had agreed to sell the property at that price.
