For the purpose of inducing plaintiff to purchase these trucks and to pay it deposit, defendant showed him self on a directed and authoriser agent of Cheung Fat-hang, Limil- ed, which was 'purported to own the said trucks,

Induced by the sald representa- ilons and warrantees, plaintif to purchuste claimed, he agreed the Ford trucks, and paid a de- Posit of $18,000 to defendant.

Failed To Deliver

There was no such emapany in ruet called the Cheung Fut-hong, Chuen further claimed. Defendant thus failed to deliver the 12 trucks within the contrast.

Plaintiff thus asked for, the re- turn of $18,000 as well as for the rescission of the contract in ques- tion.
