PEER'S ANNUITY TO ACTRESS

A woman who set up house with Lionel Walter Rothschild, second Baron Rothschild, in 1906, after she had sought his help in her stage career, declared in the Chancery Division that they separated through the "persecution" of another woman.

#11

The plaintiff was Miss Marie Stroud of Fredenson, Barbara

·Cottage, Shamley Green, Guild- action ford. who brought

the executors of Lord uga tist

will. She | Rothschild's

sought dated rectification of documents, July, 1907, amt October, 1908, pro- vading for the payment of an an muity for her and her daughter for life by Lord Rothschild.

Mr Wynn Parry, KC, for Max Fredenson, said she Brst met Lorddi Rothschild in 1903, when she was » 16. In 1905 she took a room at the house of a Mrs Lazzie Ritchie, I who was considerably older thats

he was.

Al a meeting with Lord Huths- chit at which Miss Fredenson's the baton as f was discussed suggested that he would better be able to help her at they set up house together

Under continuous pressure Miss Predenson was persuaded to take a room with a view to them hav

ng an establishment together, bul at the last moment, said Mr. Parry. She went her courage failed her. into the country after confang in Mrs Ritchie

MIX Ritchie, Counsel added. communicated with the baron, and he started to live with her

Changed Her Mind

"Then Miss Fredenson again got in touch with the baton regarding her stage career, and was finally mind," persuaded to change ber counsel continued. "She and the baron set up house together February, 1906, and in December, 1906, a daughter was born.

111

When the child was registered the father's name was given Lionel Walters. It had become essential not to give the barol's | name in view of a persistent ram-

by paugh of persecution started Mrs Itchie because she was nu longer having with the baron.

"She embarked on such a can- paign of persecution that by June. 1907. though Miss Fredenson and the baron were on the very best of terms, they reluctantly conclud- ed that they had to cease living together. The campaign involved telegrams and telephone messages to the baron's parents and rela- tives."

The question of provision for Miss Frederson arose, and a deed was drawn up for the payment of "£500 clear" annuity. No de- duction was made for tax, but after the baron's death his execu- tors deducted tax.

Miss Fredenson asked the court to rectify the deeds so as to make the payments free of tax.

The defendants maintained that the deed was not made in pur- suance with the agreement alleged by Miss Fredenson and pleaded that the payment was voluntary, made without any consideration. The omission by the baron to de- duct tax from the payments, it was contended, was voluntary act on his part.

"Made Life Wretched"

In evidence Miss Fredenson said that Mrs. Lizzie Ritchie made her life and that of the baron "the "absolutely wretched," and poor man could not stand it uny longer."

Mr. C. Harman, K.C., for the that Public Trustee, maintained the defendants had no case to answer. If persons put into deed words they intended to put. there and then found they had made a mistake in law, rectifica- tion could not be secured.

The hearing was adjourned.
