PEER'S ANNUITY TO ACTRESS

A woman who set up house with Lionel Walter Rothschild, second Baron Rothschild, in 1906, after she had sought his help in her stage career, declared in the Chancery Division that they separated through the "persecution" of another woman.

"She embarked on such a can- paign of persecution that by June. 1907. though Miss Fredenson and the baron were on the very best of terms, they reluctantly conclud- ed that they had to cease living together. The campaign involved telegrams and telephone messages to the baron's parents and rela- tives."

The question of provision for Miss Frederson arose, and a deed was drawn up for the payment of "£500 clear" annuity. No de- duction was made for tax, but after the baron's death his execu- tors deducted tax.

Miss Fredenson asked the court to rectify the deeds so as to make the payments free of tax.

The defendants maintained that the deed was not made in pur- suance with the agreement alleged by Miss Fredenson and pleaded that the payment was voluntary, made without any consideration. The omission by the baron to de- duct tax from the payments, it was contended, was voluntary act on his part.

"Made Life Wretched"

In evidence Miss Fredenson said that Mrs. Lizzie Ritchie made her life and that of the baron "the "absolutely wretched," and poor man could not stand it uny longer."

Mr. C. Harman, K.C., for the that Public Trustee, maintained the defendants had no case to answer. If persons put into deed words they intended to put. there and then found they had made a mistake in law, rectifica- tion could not be secured.

The hearing was adjourned.
