JUDGE GAOLS HIS OLD

London, April 27.

A JUDGE AND PRISONER, schoolboys together 45 years ago, had their third meeting in court yesterday. For the second time the judge sent his old schoolfellow to goal.

The judge was Mr. Cecil Whiteley, K.C., Common Serjeant at the Old Bailey. The Prisoner was Herbert Bardon Tubb, 61-year-old brother of Miss Carrie Tubb, the opera singer.

ON LEAVE ACCUSES WIFE

A private soldier home on leave from France, was granted a separation order against his wife on the grounds of her adultery with a man lodging at the house.

The case was hurrled forward as the soldier had got special leave for the hearing.

The soldier was Thomas Burke, of Liverpool-road, N., who applied. at Clerkenwell Police Court for a separ- ation order on the grounds that his wife had committed adultery with a man, who had been staying at house.

It was stated that Burke was mar- ried in April, 1939:

As the result of a letter from his landlady received In France he ob- tained special leave and returned home. He found that another man had been staying in his flat with his wife.

"SLEPT ON SOFA” ́ The wife, Ethel Elizabeth Burke, said the man in question had stayed at the flat for five or six weeks. He slept on a sofa in the sitting-room. She denied adultery.

His sentence was two years' impri- sonment for obtaining credit by false pretences and stealing articles worth £33.

Tubb was addressing the judge from the dock when he surprised the court by saying:

"I went to your school. I knew you as a good athlete and a happy

schoolboy. Prisoners know you. They talk about you in prison as one of the

fairest judges on the Bench. All they

hope is that they come before you."

Then Tubb turned to the jury who

had found him guilty. "You're

moth-eaten lot," he said.

CARRIED FROM DOCK The judge made no comment as he sent Tubb to gaol.' Tubb struggled in the dock when the warders approach- ed him. He was carried to the cells below.
