When charged, second defendant said the revolvers were left with him by third accused who promised to call for them. He had taken them to his friend in Wanchai.

During the evidence of the Chief Chinese detective His Lordship asked why first accused was not cautioned while in custody before he made any Witness statement about the others. said he thought that as accused had been brought from another station he had already been cautioned.

Sir Atholl said he would not admit statements from persons in custody who had not been cautioned.

First accused was found in posses- sion of a revolver and dagger and the Police had made up their minds to charge him. It was their duty to cau- tion him. He would not allow any of the statements.

When the verdict had been given, His Lordship, addressing second de- fendant, said that he was more a fool than a knave. It was clear what his duty when a friend left revolvers with him.

On behalf of fourth accused, Mr. Macnamara said he was a mason of good character and was involved by second defendant who knew him in the country. Kwok had brought him
