EVIDENCE FOR THE DEFENCE IN MURDER TRIAL
THAT THE DEAD MAN was bellicose and would often attack his creditors, while accused was a good man who never had any trouble with his neighbours, was evidence given this morning before the Chief Justice, Sir Atholl MacGregor, in the case in which Tang Chui is charged with the murder of Leung Ki in Chinese Street.
Mr. J. B. Prentis, Assistant Crown | Counsel, is conducting the case for the prosecution, while Mr. Percy Chen, instructed by Mr. A. S. K. Lau, for the defence.
The following are the juniors: Messrs. J. J. Cameron (foreman), H. Turner, H. L. Moors, T. A. Kuesher, S. M. Cruz, H. W. Pomeroy and Tien Tat-ming.

FROM INFORMER Questioned by Mr. Chen, witness said that when he was sent to make an arrest, he would tell the suspect that he was being arrested on suspi- cion of an offence. He would name the offence and the place and then caution the person.
In the case of an assault, he would name the victim or, if he did not know, he would keep quiet.
In this case he did not know. He got all his facts from an informer. He asked the informer who the injured person was, but the informer did not tell him.
Before calling on accused to give evidence, Mr. Chen said the defence was that there had been a fight and that accused was struck first. He was in a corner and, being attacked, look- ed round. The first thing he saw was a chopper to defend himself and, rightly or wrongly, he wielded it about still tried to strike accused and in defence. In the melee, deceased fatal blow was struck.

ACCUSED'S STORY Accused, in the box, said he came to Hong Kong as a refugee and was now hawking fruit at the corner of Chinese Street.
He knew Chan Kam-on and Leung Ki. He owed Chan 50 cents but could not pay although he was ask. ed for it twice before the incident.
On that day, from a peaceful con- versation over the debt there came a quarrel. Leung scolded witness and threatened to drive him from Chinese Street. He walked away and Leung followed. Leung asked him if he was going to pay and witness told him to wait. Leung struck him with his Ast and shouted to Chan Kam-on to strike. He looked for something- to defend himself and saw the chopper, which he picked up. Chan ran away. Leung was looking very angry and began swinging his arms.
In the fight Leung fell down. He did not strike Leung after he had fallen, but ran away. He threw the chopper away. He had never been in a fight before.
In reply to Mr. Prentis, witness denied that Leung shouted "Save life" and ran away when he was attacked.
