COAL DISPUTE LITIGATION
The dispute between the Hang Shung Company, and the Kwang Sang Lung, involving ‘a claim for $4,859.82, the price of 174 tons of undelivered coal, was continued before the Chief Justice, Sir Atholl MacGregor, at the Supreme Court this morning.
Plaintiffs, the Hang Shung Com- pany, are represented by Mr. H. C. Macnamara, instructed by Mr. G. S. Hugh Jones, while defendants represented by the Hon. Mr. Leo D'Almada, instructed by Mr. H. A. de Botelho.

Mr. D'Almada submitted that on the evidence of plaintiffs, there was no case to answer. Counsel referred to evi- dence by Cheung Yin-chong and Lo Kit-man, and to the correspondence between plaintiffs and defendants, and pointed out that it all illustrated that the property and risk were in plain-. tiffs. All probabilities submitted Mr. D'Almada, pointed to the fact that the risk was in plaintiffs, and that defen- dants were entitled to judgment.
Mr. Macnamara made a brief reply, following which the Chief Justice rul- ed that defendants had a case to an- swer.

Cross-examined by Mr. Macnamara, witness replied that defendant were to have full, control of the coal until 90 per cent had been paid. The property passed to plaintiffs immediately it left the scales on the ship.
-Mr. Macnamara: "Yet you have not a serap of paper to show that plain- tiffs received 1,603.5 tons of coal from you?" Witness made no reply.
Referring to the Bill of Lading, Mr. Macnamara asked witness when this document was presented to plaintiffs he could not remember. for signature. Witness replied that
"I put it to you that it was not until December 28 that you asked them to sign it." Witness again made no re- ply.
"You asked them to sign it after you had heard that there was a short- age of coal."-"I did not hear of the shortage until informed by plaintiffs through their solicitors."
